He wasn\u2019t charged."},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">After investigators determined that one of the Navy\u2019s senior-most recruiters likely violated military sexual assault laws when he touched a female chief\u2019s breast in 2019, leadership declined to charge <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2021\/08\/24\/heres-what-led-to-the-navy-national-chief-recruiters-firing-last-year\/\" target=\"_blank\">Master Chief Navy Counselor Franklin Tiongco<\/a> and instead disciplined him for sexual harassment and assault, according to a Naval Criminal Investigative Service investigation obtained by Navy Times.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The incident began with a khaki blouse malfunction. While teaching a class for soon-to-be executive officers in April 2019, the chief paused instruction when she noticed a student staring at her chest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The chief\u2019s top had bunched up, leaving a gap between her chest-level buttons. The married mother of three stepped out of the classroom at <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2020\/05\/15\/navy-fires-national-chief-recruiter\/\" target=\"_blank\">Navy Recruiting Command<\/a> headquarters in Millington, Tennessee, and explained the situation to Tiongco, who was the service\u2019s <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2020\/05\/15\/navy-fires-national-chief-recruiter\/\" target=\"_blank\">national chief recruiter<\/a> at the time and part of recruiting command\u2019s leadership.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cYour dang button is open,\u201d the chief recalled Tiongco saying.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Then, in the middle of a Navy hallway, Tiongco slid two fingers into the blouse gap and touched the chief\u2019s breast beneath her bra, according to the chief and the NCIS investigation that followed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWhoa, yellow light behavior,\u201d a master chief who witnessed the incident said, indicating that this was \u201cmore than an incidental touch,\u201d according to a copy of the investigation obtained by Navy Times.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2021\/08\/24\/heres-what-led-to-the-navy-national-chief-recruiters-firing-last-year\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"241\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/tiongco-pic.png.png?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Here\u2019s what led to the Navy national chief recruiter\u2019s firing last year<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Navy Counselor Master Chief Franklin Tiongco was relieved in May 2020.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">\u201cBro, don\u2019t do that,\u201d the chief recalled the master chief telling Tiongco, according to the investigation. \u201cWhat are you doing?\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAfter he said that, Tiongco laughed, and I walked away and he walked into the classroom to do his introduction,\u201d the chief told Navy Times last week.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tiongco did not respond to calls seeking comment for this report. The chief requested anonymity and Navy Times does not identify people who say they have been sexually assaulted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The master chief who witnessed the incident later described it as \u201cstupidly inappropriate but benign\u201d to NCIS agents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the chief recalled it differently, and said that when Tiongco touched her, she froze.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI felt my body tighten up,\u201d the 39-year-old told Navy Times. \u201cI immediately just felt like my heart stopped.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The chief said she had been sexually assaulted earlier in her 21-year Navy career, and dread flooded back.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cNot again,\u201d she thought. \u201cWhat do I do?\u201d<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"854\" height=\"660\" src=\"\/wp-content\/uploads\/2026\/08\/safe-helpline.png.png\" alt=\"\" class=\"wp-image-48372\" srcset=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/safe-helpline.png.png 854w, https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/safe-helpline.png.png?resize=300,232 300w, https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/safe-helpline.png.png?resize=768,594 768w\" sizes=\"auto, (max-width: 854px) 100vw, 854px\" \/><figcaption class=\"wp-element-caption\">The Defense Department&#8217;s Safe Helpline offers 24-hour support for servicemembers worldwide. Dennis Velez<\/a> , declined to charge him with a crime.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Velez instead gave Tiongco nonjudicial punishment \u201cfor sexual harassment and assault on a petty officer,\u201d and the master chief received a letter of reprimand, the investigation states.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The chief said she was only notified that Tiongco was being administratively disciplined and not court-martialed a day before his hearing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Following Tiongco\u2019s NJP in June 2020, the NCIS investigation shows he submitted a request to waive any administrative separation board process and be allowed to retire, a request that Velez approved in August 2020.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Now, 18 months after those events in<b> <\/b>Building 750 aboard Naval Support Activity Mid-South, Tiongco is getting ready to leave the Navy this week following 30 years in uniform, officials said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A defense official who requested anonymity because they weren\u2019t authorized to speak on personnel matters said Tiongco was reduced in rank to E-8 and will retire at that pay grade.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The chief said she was left traumatized by the incident and debated for months whether she should report what happened.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Military sexual assault prevention is a theme pushed by the Pentagon and service brass in speeches, social media posts and mandated training sessions. (Navy)<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Navy officials declined to discuss the specifics of Tiongco\u2019s punishment but defended Velez\u2019s decision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cRear Adm. Velez, after consulting with the trial experts at Regional Legal Service Office Southeast, elected to impose certain and swift non-judicial punishment against NCCM Tiongco at Admiral\u2019s Mast,\u201d NRC spokeswoman Cmdr. Lara Bollinger said in an email. \u201cNavy Recruiting Command takes all allegations of sexual assault and harassment very seriously and remains committed to the Navy\u2019s mission to prevent and eliminate sexual harassment and assault from its ranks.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Well before leadership declined to charge Tiongco, the NCIS investigation suggests several senior enlisted leaders failed to help the chief.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the hallway where Tiongco touched her, the master chief witness never reported the incident.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Right after, the chief said she went to get a jacket and told her senior chief what happened.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Christensen said the senior chief had a legal obligation to route such an unrestricted sexual assault report, but he also did nothing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When approached by NCIS agents in early 2020, Tiongco invoked his right to remain silent.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2018\/04\/23\/carrier-john-c-stennis-throws-sexual-assault-awareness-rodeo\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"157\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/SAPR-Rodeo-1.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Carrier John C. Stennis throws sexual assault awareness rodeo<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The rodeo featured trivia, games and obstacle course to raise awareness of the Navy&#039;s sexual assault resources.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Agents \u201capprehended\u201d the national chief recruiter on April 14, 2020, and took his mugshot, fingerprints and a DNA sample for inclusion in FBI databases, according to the investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That same day, the NCIS investigation states that agents and NRC\u2019s legal staff \u201cconsulted and coordinated\u201d<b> <\/b>on the evidence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe determination was made that there was sufficient probable cause to believe that (Tiongco) committed a violation of Uniform Code of Military Justice (UCMJ) Article 120d (Abusive Sexual Contact),\u201d the NCIS report states.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A command assessment \u201crecommended no prosecution of abusive sexual contact due to insufficient evidence of intent,\u201d according to the investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But intent is often murky in sex crime cases, Christensen said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cRarely does somebody say, \u2018I\u2019m grabbing your breast for sexual gratification,\u2019\u201d Christensen said. \u201cYou\u2019re looking at circumstances. Does the guy have a legitimate reason to be touching her breast? (NCIS)<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\"><b>\u2018What we have to deal with\u2019<\/b><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The chief contacted Navy Times after a story last week involving an internal NRC investigation into Tiongco that involved inappropriate sexual comments he and others made to another female chief during a house party in 2019.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That probe found \u201csufficient evidence\u201d that Tiongco sexually harassed the woman.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">NCIS agents interviewed sources regarding that same \u201ccommand function\u201d house party, where Tiongco is accused of joining others in mocking another female chief regarding a sexual act and chanting about it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The woman, who was at the party with her kids and boyfriend, \u201cstated she felt trapped by the individuals chanting and was humiliated,<b>\u201d<\/b> and believed that her subsequent evaluations suffered due to the incident, the investigation states.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As the months have passed, the chief said she has been waiting for NCIS to provide her a copy of the investigation. Navy Times provided her a copy of the investigation last week.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While debating whether to report what happened, the chief said the trauma took its toll. She kept it from everyone, even her husband, and didn\u2019t report the incident until early 2020, following a \u201cmental breakdown\u201d after she was moved to a desk right outside Tiongco\u2019s office.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cMy scalp would blister,\u201d the chief said. \u201cI couldn\u2019t sleep. I found myself having nightmares and I would replay the scenario over and over.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI found myself being distant with my daughters and my family,\u201d she continued. \u201cI would sit in my home office and just cry. I had a lot of regret \u2026 my chest was tightening. I gained weight.
