{"id":23080,"date":"2019-07-30T22:25:18","date_gmt":"2019-07-30T22:25:18","guid":{"rendered":"https:\/\/one.sightlinemg.com\/navytimes\/uncategorized\/2019\/07\/30\/their-case-collapsed-in-court-but-4-navy-prosecutors-still-netted-nams\/"},"modified":"2026-08-08T19:14:44","modified_gmt":"2026-08-08T19:14:44","slug":"their-case-collapsed-in-court-but-4-navy-prosecutors-still-netted-nams","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2019\/07\/30\/their-case-collapsed-in-court-but-4-navy-prosecutors-still-netted-nams\/","title":{"rendered":"Their case collapsed in court but 4 Navy prosecutors still netted NAMs"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">On July 2 \u2014 more than nine months after he was charged with murder and a string of other war crimes allegedly committed in Iraq in 2017 \u2014 Special Warfare Operator Chief Edward \u201cEddie\u201d Gallagher strolled out of a Naval Base San Diego courtroom a free man, <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2019\/07\/02\/seal-war-crimes-suspect-not-guilty-on-murder-charge\/\" target=_blank>guilty only of appearing in an inappropriate photograph<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Despite the collapse of their case against him, four military attorneys netted Navy Achievement Medals eight days later for their roles in his prosecution, according to records released to Navy Times following a Freedom of Information Act request.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Presented at the Navy Region Southwest Legal Service Office in San Diego on July 10 by Capt. Gary E. Sharp \u2014 the chief of staff of Naval Legal Services Command in Washington \u2014 the decorations included NAMs for three lieutenants, George O. Hageman, Brian P. John and Scott I. McDonald, plus a female officer whose name and rank were redacted by the Navy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Signed by Capt. Meg Larrea, the commanding officer for RLSO Southwest, McDonald\u2019s NAM citation praised him for his \u201csuperior performance\u201d after reviewing a (redacted) number of hours of video and reading a (redacted) number of pages of discovery to prep for a trial where he \u201cbrilliantly cross-examined defense witnesses\u201d and \u201cexpertly delivered the government\u2019s case in rebuttal.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">John\u2019s NAM lauded him for his \u201csuperior performance&#8221; and \u201cbrilliant legal acumen\u201d despite an \u201cunforeseen personnel change\u201d that forced him to fleet up to become a top prosecutor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Those pair of awards raised eyebrows because although those Navy attorneys weren\u2019t found culpable of wrongdoing, the prosecution team was sanctioned by Navy judge Capt. Aaron Rugh for violating the constitutional rights of Gallagher.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Part of the punishment included booting Cmdr. Christopher Czaplak, the lead prosecutor, for <a href=\"https:\/\/www.navytimes.com\/news\/2019\/06\/04\/lead-navy-prosecutor-in-seal-war-crime-case-out-over-email-spying\/\" target=_blank>a warrantless surveillance program<\/a> cooked up with Naval Criminal Investigative Service agents <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2019\/05\/13\/defense-attorneys-for-navy-seal-accused-of-war-crimes-say-prosecutors-spied-on-them\/\" target=_blank>to track emails sent by defense attorneys and Navy Times.<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Czaplak appears to have been the \u201cunforeseen personnel change&#8221; and it remains unclear if the Navy will present him with an award.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The spying wasn\u2019t the only accusation of prosecutorial and police misconduct dogging the case. They were accused of manipulating witness statements to NCIS agents; using immunity grants and a bogus \u201ctarget letter\u201d in a crude attempt to keep pro-Gallagher witnesses from testifying; illegally leaking documents to the media to taint the military jury pool; and then trying to cover it all up when they got caught.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And although John was praised in his NAM for preparing the government\u2019s \u201cmost challenging witnesses,\u201d he was the prosecutor questioning Special Warfare Operator 1st Class Corey Scott on June 24, when the SEAL <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2019\/06\/21\/legal-bombshell-explodes-on-seal-war-crimes-trial\/\" target=_blank>dropped a bombshell John didn\u2019t know was coming<\/a>: Scott killed the prisoner of war in Iraq, not Gallagher.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2019\/06\/21\/legal-bombshell-explodes-on-seal-war-crimes-trial\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"225\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/AP19171574424726.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Legal bombshell explodes on SEAL war crimes trial<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">SEAL medic says that Special Warfare Operator Chief Edward \u201cEddie\u201d Gallagher didn&#039;t kill an Islamic State prisoner of war.  He did.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Gallagher\u2019s civilian defense attorney, <a href=\"https:\/\/parlatorelawgroup.com\/about\" target=_blank>Timothy Parlatore<\/a>, told Navy Times he was concerned that Big Navy was handing out NAMs to the prosecution before the convening authority had even ruled on his client\u2019s sentence. He called on the Pentagon to investigate Larrea\u2019s decision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cHow does Capt. Larrea still have a job?&#8221; he asked. \u201cWhy hasn\u2019t she been fired? They\u2019re giving out awards to the members of a prosecution team that was sanctioned for unlawful actions and substandard conduct.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Parlatore pointed out that Gallagher was found guilty of only one charge \u2014 posing with a dead detainee\u2019s body \u2014 but he offered to plead guilty to that crime before the trial kicked off.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThey\u2019re awards praising an outcome we offered before the trial,\u201d Parlatore said. \u201cI don\u2019t understand it.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Navy spokesman Cmdr. Jereal Dorsey confirmed &#8220;that an awards ceremony occurred where letters of commendation and Navy achievement medals were presented to individuals on the prosecution team who were deemed, by their immediate superiors, to have performed above their normal duties.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He pointed to the three NAMs awarded during the same ceremony for legalman petty officers, plus letters of commendations for a gunner\u2019s mate third class, legalman second class and ships serviceman seaman.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Critics told Navy Times that they weren\u2019t objecting to any awards for enlisted sailors, who they agreed toiled for long hours on the case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead, they\u2019ve homed in on the NAMs for the two officers who became legal architects of a failed investigation already tainted by allegations of professional misconduct and words Capt. Jacob X. \u201cJake\u201d Portier, the officer in charge of Gallagher in Alpha Platoon, SEAL Team 7, filed a pair of motions seeking to dismiss the case against him.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He\u2019s accused of failing to report war crimes that Gallagher\u2019s military panel said never occurred \u2014 part of a cover up by Gallagher they believe he never attempted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lt. McDonald is one of Portier\u2019s prosecutors. Despite the setbacks in the Gallagher case, and and the rest of the team have pushed on with Portier\u2019s trial, which is slated to begin on Sept. 3.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis gives a new meaning to \u2018Everyone gets a trophy,\u2019\u201d said<a href=\"https:\/\/www.facebook.com\/LawOfficesofJeremiahJSullivanIII\" target=_blank> Jeremiah J. Sullivan III,<\/a> Portier\u2019s lead civilian defense attorney. \u201cBut I\u2019m not surprised.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Navy spokesman Dorsey said that the service won\u2019t \u201ccomment on matters currently in litigation, to include motions,\u201d but those in the Portier case take a whack at both the awards and Capt. Sharp\u2019s role in presenting them.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Drafted by Coast Guard Lt. Cmdr. Stewart L. Sibert and Air Force Lt. Col. Nicholas W. McCue, the filing alleges that during the ceremony Sharp announced \u201cno matter the result, we were right to prosecute\u201d Gallagher and that \u201cjustice was done.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To them, Sharp insinuated that Gallagher had \u201ccommitted more serious misconduct than he was found guilty of.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And they say that\u2019s a problem because the judge who heard the Gallagher case and continues to preside over Portier\u2019s, Capt. Rugh, was in the room when Sharp said it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At the end of the ceremony, he was even invited to shake the hands of those bestowed with awards \u201cand congratulate them on their achievements,&#8221; according to the motion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The defense team\u2019s filing doesn\u2019t call on Rugh to step down before Portier\u2019s trial, but it suggests they must question him under oath to make sure he can remain an impartial judge during the upcoming trial.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That dramatic hearing is expected to play out in a Naval Station San Diego courtroom on Friday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Parlatore praises Rugh, but he questions why the prosecution is persisting in the Portier case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt\u2019s shocking that after the embarrassment of the Navy during Eddie\u2019s trial, the Navy intends to go forward with their false claims against Lt. Portier,&#8221; said Parlatore.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI predict Mr. Jay Sullivan is going to win an acquittal \u2014 if the case isn\u2019t dismissed before
