{"id":23593,"date":"2019-06-03T21:37:19","date_gmt":"2019-06-03T21:37:19","guid":{"rendered":"https:\/\/one.sightlinemg.com\/navytimes\/uncategorized\/2019\/06\/03\/supreme-court-to-hear-pirate-ship-case\/"},"modified":"2026-08-08T19:09:52","modified_gmt":"2026-08-08T19:09:52","slug":"supreme-court-to-hear-pirate-ship-case","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2019\/06\/03\/supreme-court-to-hear-pirate-ship-case\/","title":{"rendered":"Supreme Court to hear pirate ship case"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">WASHINGTON \u2014 A dispute involving the pirate Blackbeard\u2019s <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2019\/03\/28\/what-researchers-are-learning-about-pirate-weapons\/\" target=\"_blank\">sunken ship<\/a> is on deck for the Supreme Court\u2019s next term.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The justices said Monday they will hear arguments in the fall in a copyright case involving the <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2019\/03\/28\/what-researchers-are-learning-about-pirate-weapons\/\" target=\"_blank\">Queen Anne\u2019s Revenge<\/a>, which was discovered off North Carolina\u2019s coast in 1996.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case pits the state of North Carolina against a company that has documented the ship\u2019s recovery.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ship is the property of the state, but under an agreement, North Carolina-based Nautilus Productions has for nearly two decades documented the ship&#8217;s salvage. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the process, the company and copyrighted photos and videos of the ship.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2019\/03\/28\/what-researchers-are-learning-about-pirate-weapons\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"188\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Blackbeard7.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">What researchers are learning about pirate weapons!<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Armaments from Blackbeard&#039;s ship showcase the art of violence on the high seas.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">In 2013, the state and Nautilus resolved one copyright dispute over photos the state posted on the website of the North Carolina Department of Natural and Cultural Resources, which oversees the ship\u2019s recovery and preservation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The sides reached a settlement agreement in which neither side admitted wrongdoing. But Nautilus later sued after the state posted a handful of Nautilus videos on a state YouTube channel and used a photo in a newsletter. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In 2015, state lawmakers passed a law that made shipwreck videos and photographs in the state\u2019s custody public records. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In its lawsuit, Nautilus argued the law should be declared unconstitutional.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A trial court initially allowed Nautilus&#8217; lawsuit to go forward. The judge pointed to the federal Copyright Remedy Clarification Act, a 1990 law that allows private parties to sue states for violations of federal copyright law. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">North Carolina appealed, arguing that the federal law was unconstitutional and it was immune from being sued. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An appeals court agreed, and now the Supreme Court will decide whether the lawsuit can proceed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nautilus&#8217; owner, Rick Allen, said in a statement Monday that he was gratified the court had agreed to hear his case. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">North Carolina Department of Justice spokeswoman Laura Brewer said in an email that the office looks forward to continuing to defend the state in the case.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2018\/12\/21\/wood-from-blackbeards-flagship-has-become-very-precious\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"188\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Blackbeard7.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Wood from Blackbeard\u2019s flagship has become \u2018very precious\u2019<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Storms, strong currents and shipworms have destroyed all but a few remaining pieces of the famed Queen Anne&#039;s Revenge, which capsized 300 years ago.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">The Queen Anne\u2019s Revenge was originally a French ship when Blackbeard, the Englishman <a href=\"https:\/\/www.navytimes.com\/home\/left-column\/2018\/10\/29\/blackbeard-the-pirate-goes-on-trial-in-nc-courtroom\/\" target=_blank>Edward Teach<\/a>, captured the vessel in the fall of 1717. He armed the ship with 40 cannons and made it his flagship.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The following year, Blackbeard was sailing north from Charleston, South Carolina, when the ship went aground in what&#8217;s now called Beaufort Inlet.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Blackbeard abandoned the ship.
