Trump ordered the Navy to modify the detention of Special Warfare Operator Chief Edward \u201cEddie\u201d Gallagher, who is behind bars awaiting a court-martial trial in San Diego for allegedly stabbing to death an Islamic State prisoner.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIn honor of his past service to our Country, Navy Seal <a href=\"https:\/\/twitter.com\/hashtag\/EddieGallagher?src=hash\"><del>#<\/del><b>EddieGallagher<\/b><\/a> will soon be moved to less restrictive confinement while he awaits his day in court,&#8221; Trump tweeted. \u201cProcess should move quickly!\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In his message, the president nodded to the Fox News Network and U.S. Rep. Ralph Norman, a South Carolina Republican who has led the fight alongside <a href=\"https:\/\/www.navytimes.com\/news\/pentagon-congress\/2018\/08\/22\/charges-against-duncan-hunter-detail-family-vacations-football-tickets-other-luxury-items-with-illegal-funds\/\" target=_blank>embattled Rep. Duncan Hunter<\/a>, R- Calif., to free Gallagher.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Trump stopped short of ending Gallagher\u2019s prosecution, something Hunter and other supporters have urged the president to do.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Norman had taken to Twitter on Friday to reveal he had telephoned Trump about Gallagher\u2019s imprisonment. In <a href=\"https:\/\/twitter.com\/RepRalphNorman\/status\/1111666802092896259\" target=_blank>his message<\/a>, Norman thanked the president for deciding to move Gallagher \u201cto less restrictive confinement while he awaits his day in court.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gallagher, 39, was arrested on Sept. 11 while receiving medical care at Camp Pendleton and has been held in San Diego\u2019s Naval Consolidated Brig Miramar \u201c<a href=\"https:\/\/www.navytimes.com\/news\/pentagon-congress\/2019\/03\/28\/lawmakers-want-navy-seal-released-from-the-brig-ahead-of-war-crimes-trial\/\" target=_blank>with sex offenders, rapists and pedophiles<\/a>,\u201d the lawmakers blasted during a Capitol Hill rally on Thursday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gallagher has pleaded not guilty to war crimes charges stemming from a deployment to Iraq nearly two years ago.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Military prosecutors contend that he murdered an unarmed and incapacitated teenage ISIS detainee receiving medical aid on May 3, 2017, near the Iraqi city of Mosul before later posing with the corpse during a macabre re-enlistment ceremony.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They also allege Gallagher gunned down unwitting civilians with his sniper rifle, bragged about racking up the kills and threatened to intimidate and publicly out fellow members of SEAL Team 7 who complained to superiors and investigators about him.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Officials also charged his platoon leader, Lt. <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2018\/10\/23\/second-seal-arrested-in-war-crimes-probe\/\">Jacob X. \u201cJake\u201d Portier<\/a>, for purportedly trying to conceal his chief\u2019s crimes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Unlike Gallagher, however, Portier has remained free during the pretrial phase of the proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Like Gallagher, Portier also has vowed to clear his name at trial.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/navytimes\/news\/pentagon-congress\/2019\/03\/28\/lawmakers-want-navy-seal-released-from-the-brig-ahead-of-war-crimes-trial\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"226\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/GallagherEdited.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Lawmakers want Navy SEAL released from the brig ahead of war crimes trial<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Special Warfare Operator Chief Edward Gallagher faces charges of killing a wounded detainee and shooting at civilians in Iraq.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">It remains unclear what Navy leaders will do to modify Gallagher\u2019s incarceration or which command will handle the changes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Because of the serious nature of his alleged crimes and claims that Gallagher sought to intimidate SEAL witnesses and obstruct justice, he was placed in the brig by California-based SEAL Group 1 before he was arraigned.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But Group 1 turned over Gallagher\u2019s case to San Diego\u2019s Navy Region Southwest after his court-martial trial was greenlighted by <a href=\"https:\/\/www.navy.mil\/navydata\/bios\/bio.asp?bioID=857\">Rear Adm. Yancy B.&#8221;Lurch&#8221; Lindsey<\/a>, the region\u2019s former commander, following a legal review of the SEAL\u2019s <a href=\"https:\/\/www.armytimes.com\/news\/your-navy\/2018\/11\/15\/a-jekyll-and-hyde-portrait-emerges-of-the-seal-accused-of-murdering-an-islamic-state-prisoner\/\">two-day Article 32 hearing in November<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Officials have not responded to questions about what the president\u2019s order means for Gallagher and even the SEAL\u2019s legal team indicated they\u2019re still learning what it all means.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But it could mean Gallagher rejoining his family in Florida, where the 19-year Navy veteran planned to retire before his arrest and detention in California.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe timeline is still being worked out and the command is still deciding the reduced moral restrictions that will be placed on Eddie,\u201d wrote one of his civilian attorneys, and <a href=\"https:\/\/www.militarydefender.com\/\">Phillip Stackhouse<\/a>, in a message to Navy Times.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;Typically these moral restrictions will include reporting in-person or reporting by telephone one\u2019s whereabouts for the day and then what are called \u2018protective orders\u2019 being issued that direct one from contacting another (witness or co-defendant).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;So, for example in Eddie\u2019s case, there might be a protective order that informs him to have no contact with potentially adverse witnesses against him.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWhile I don\u2019t know the timelines affirmatively, the confinement facility is staffed 24 hours per day and so is Eddie\u2019s command. One would hope that when a directive has been issued by the president it would happen quickly. At issue could be how often Gallagher checks in with base personnel and whether he\u2019s provided access to telephone and internet communications.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s highly unlikely that Gallagher will be confined at <a href=\"https:\/\/www.cnic.navy.mil\/regions\/cnrsw\/installations\/navbase_coronado.html\" target=_blank>Naval Base Coronado<\/a>, home to Group 1, because so many of the potential witnesses against him are assigned to commands there.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gallagher\u2019s court-martial at Naval Base San Diego initially was slated for Feb. 19, but the military judge hearing his case postponed it to May 28 following concerns expressed by the defense team that they lacked enough time to analyze reams of evidence compiled by investigators.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Those files appear to be growing. During the latest legal lull, military investigators expanded their probe into Gallagher\u2019s alleged misconduct involving obstruction of justice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Search warrant filings, Naval Criminal Investigative Service emails and other records <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2019\/03\/27\/war-crimes-case-expands-to-seal-team-6\/\" target=_blank>recently leaked to Navy Times<\/a> reveal that in early February they began seizing cellphones and data from fellow SEALs at the Naval Special Warfare Development Group \u2014 or DEVGRU.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They appear to be looking for evidence that Gallagher urged a \u201cMean Girls\u201d clique of SEALs there to help him avoid justice and retaliate against junior sailors who ratted him out for the alleged war crimes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><b>UPDATE: <\/b>Gallagher was released from the brig on Saturday evening in San Diego.
