{"id":26922,"date":"2019-10-28T20:48:45","date_gmt":"2019-10-28T20:48:45","guid":{"rendered":"https:\/\/one.sightlinemg.com\/navytimes\/uncategorized\/2019\/10\/28\/vcno-hints-reforms-looming-for-navys-jag-corps\/"},"modified":"2026-08-08T19:04:43","modified_gmt":"2026-08-08T19:04:43","slug":"vcno-hints-reforms-looming-for-navys-jag-corps","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2019\/10\/28\/vcno-hints-reforms-looming-for-navys-jag-corps\/","title":{"rendered":"VCNO hints reforms looming for Navy\u2019s JAG Corps"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Tasked with probing potential problems plaguing the way the sea service recruits, trains and retains a competent and ethical corps of uniformed attorneys, the 40th vice chief of naval operations on Friday telegraphed looming reforms.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Speaking <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2019\/10\/25\/vcno-carrier-lincoln-extended-flattop-ford-delayed-but-navy-readiness-woes-getting-fixed\/\" target=\"_blank\">at the annual Military Reporters and Editors conference<\/a> at Navy League headquarters in Arlington, Virginia, Adm.<a href=\"https:\/\/www.navy.mil\/navydata\/bios\/navybio.asp?bioID=681\" target=\"_blank\"> Robert Burke<\/a> said that his comprehensive review of the <a href=\"https:\/\/www.jag.navy.mil\/\" target=\"_blank\">Judge Advocate General\u2019s Corps<\/a> has reached its \u201cfinal phases\u201d and legal experts culled from the U.S. Department of Justice, federal courts, private sector law firms and the other armed forces have made important recommendations to guide changes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe have some solid recommendations,\u201d Burke said. \u201cThe report is not final, so it\u2019s not prudent for me to talk about it. But these are solid and tangible things that we can change about the JAG community in the Navy \u2014 and, similarly, for the Marine Corps, who will benefit from these findings, as well \u2014 and do those things a little bit differently.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Burke said those recommendations likely will influence \u201chow we train, how we acculturate, how we organize\u201d the Navy\u2019s legal ranks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On Aug. 22, Navy Secretary Richard V. Spencer<a href=\"https:\/\/www.militarytimes.com\/news\/your-navy\/2019\/08\/22\/navsec-orders-comprehensive-review-of-navy-marine-corps-jags\/\" target=_blank> expanded Burke\u2019s ongoing investigation<\/a> to the Marines, ordering them to launch an independent analysis of their legal community including \u201cany corrective actions necessary\u201d to fix the laws, regulations, policies, resourcing, organization, professional development, command relationships, oversight, staffing levels and career progression for its personnel.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Navy and Marine Corps\u2019 reports are due on SECNAV\u2019s desk by Nov. 22.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2019\/08\/02\/navy-orders-probe-into-judge-advocate-general-corps-leaders\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Gallagher-sentence-2.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Navy orders probe into actions of Judge Advocate General Corps leaders<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Chief of Naval Operations Adm. John Richardson also dismissed all charges against a SEAL officer charged with covering up war crimes and stopped the ongoing probe of another special operator who confessed to murdering a detainee in Iraq in 2017.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Burke acknowledged the role the investigation, prosecution and acquittal of Special Warfare Operator Chief Edward \u201cEddie\u201d Gallagher played in sparking the review, although he indicated it wasn\u2019t the only concern about the Navy\u2019s legal personnel to percolate to the highest reaches of the sea service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On July 2, a military panel of his peers at Gallagher\u2019s San Diego court-martial trial <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2019\/07\/02\/seal-war-crimes-suspect-not-guilty-on-murder-charge\/\">cleared him<\/a> on premeditated murder, obstruction of justice and all but one other charge tied to a 2017 deployment with Alpha Platoon, SEAL Team 7, to Iraq.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The trial spotlighted both the Navy\u2019s prosecutors and the Naval Criminal Investigative Service special agents who probed the war crimes allegations.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Shortly before his court-martial trial kicked off, Navy judge Capt. Aaron Rugh sanctioned the prosecution team for violating the defendant\u2019s constitutional rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Part of Rugh\u2019s punishment included booting Cmdr. Christopher Czaplak, the lead prosecutor, for his role in <a href=\"https:\/\/www.navytimes.com\/news\/2019\/06\/04\/lead-navy-prosecutor-in-seal-war-crime-case-out-over-email-spying\/\">a warrantless surveillance program<\/a> cooked up with Naval Criminal Investigative Service agents <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2019\/05\/13\/defense-attorneys-for-navy-seal-accused-of-war-crimes-say-prosecutors-spied-on-them\/\">to track emails sent by defense attorneys and Navy Times.<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And the spying wasn\u2019t the only allegation of prosecutorial and police misconduct dogging the case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They were accused of manipulating witness statements to NCIS agents; using immunity grants and a bogus \u201ctarget letter\u201d in a crude attempt to keep pro-Gallagher witnesses from testifying; illegally leaking documents to the media to taint the military jury pool; and then trying to cover it all up when they got caught.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/news\/your-military\/2019\/08\/22\/navsec-orders-comprehensive-review-of-navy-marine-corps-jags\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"199\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Spencer-arms.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">SECNAV orders comprehensive review of Navy, Marine Corps JAGs<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">More fallout from a botched SEAL war crimes trial.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Burke said that he and the former chief of naval operations \u2014 the recently retired Adm. John Richardson \u2014 decided to act after \u201csome pressure on the JAG Corps to, frankly, do some retrospection and self-policing&#8230; and to go look hard at yourselves and what you need to do to address these issues.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Burke didn\u2019t elaborate on growing concerns about Navy JAGs at the highest level of the sea service, but internal emails and documents provided to Navy Times hint at a legal community feeling Richardson\u2019s heat months before Gallagher\u2019s trial even began.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">For example, a May 29 email chain that included Navy Judge Advocate General Vice Adm. John G. Hannick discusses prepping for an upcoming and important meeting with Richardson.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Other emails show that Hannick and other top JAG leaders were informed almost daily on the course of the Gallagher case, including media clippings that disclosed the warrantless spying by NCIS on Navy Times, defense attorneys and their paralegals.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Despite the CNO\u2019s concerns, Burke disclosed on Friday that both he and Richardson found the responses from the JAGs to be \u201cnot very satisfying at the time\u201d and the comprehensive review kicked off.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Burke also indicated that although his review\u2019s charter did not \u201cinclude an examination&#8221; of the investigative agency\u2019s internal processes, his team looked at the role it plays within the Navy and how agents interact with the sea service\u2019s attorneys.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Amid a string of JAG scandals, Adm.
