{"id":27774,"date":"2019-05-23T01:52:06","date_gmt":"2019-05-23T01:52:06","guid":{"rendered":"https:\/\/one.sightlinemg.com\/navytimes\/uncategorized\/2019\/05\/23\/seal-defense-claims-prosecution-withheld-information-from-judge-about-email-spying\/"},"modified":"2026-08-08T19:12:41","modified_gmt":"2026-08-08T19:12:41","slug":"seal-defense-claims-prosecution-withheld-information-from-judge-about-email-spying","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2019\/05\/23\/seal-defense-claims-prosecution-withheld-information-from-judge-about-email-spying\/","title":{"rendered":"SEAL defense claims prosecution withheld information from judge about email spying"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">SAN DIEGO \u2014 The trial for <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2019\/04\/22\/what-motivated-fellow-seals-to-dime-out-eddie-gallagher\/\">Special Operations Chief Edward Gallagher<\/a>, the Navy SEAL accused of murdering an injured teenage ISIS fighter in Iraq in 2017, has been delayed amid a whirlwind of allegations that the prosecution in the case was illegally spying on defense attorneys and a journalist while withholding information from the judge.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a Naval Base San Diego courtroom Wednesday, Gallagher\u2019s defense attorney, Tim Parlatore, said he would seek to recuse the prosecution after emails distributed to 13 lawyers and paralegals on their team \u2014 as well as one to the <a href=\"https:\/\/www.militarytimes.com\/2019\/05\/17\/secret-tracking-device-found-in-navy-email-to-navy-times-amid-leak-investigation-raises-legal-ethical-questions\/\" target=\"_blank\">editor of Navy Times<\/a> \u2014 were discovered to contain a hidden electronic tracking device.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The tracking device was capable of revealing the location of the user, how long a user spent on a web page, what browser was being used, and other information, Parlatore said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe got a lot of documents earlier this week that paint a pretty disturbing picture of what the prosecution did in this case, how they targeted the defense, how they targeted a member of the media,\u201d Parlatore told Navy Judge Capt. Aaron Rugh.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under U.S. criminal law, authorities normally have to obtain a subpoena or court order to acquire IP addresses or other metadata from a private computer. Not using one could be a violation of existing federal privacy laws, including the Electronic Communications Privacy Act.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Parlatore implored Rugh to assess whether the judge had any knowledge that the prosecution failed to turn over such information, because if he did, Parlatore told the judge, \u201cyou were involved in the transactions in question.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If so, procedural flaws such as this would constitute a call for the removal of the judge from the case, Gallagher\u2019s defense argued.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Following the hearing, however, Parlatore adjusted his tone when asked about Rugh\u2019s knowledge of the prosecution\u2019s alleged misdeeds.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWhat we [originally] believed is that the judge authorized the prosecutors to spy on the defense team,\u201d he told reporters outside the courthouse.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cNow looking at things, it appears the prosecutors may have lied to the judge, and that [the judge] didn\u2019t authorize it and didn\u2019t know what they were really doing. &#8230; What we\u2019re going to be filing motions on is to recuse the prosecutors, to dismiss the case for the proprietorial misconduct.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Parlatore has said that the case\u2019s Navy prosecutor, Cmdr. Christopher Czaplak, admitted in court on May 10 to sending the emails containing tracking devices.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One such email even found its way to the inbox of Marc Mukasey, a member of President Donald Trump\u2019s legal team who, on speaker phone in the courtroom Wednesday, was sworn in as a member of Gallagher\u2019s defense team.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Given the president\u2019s recent proclamation that he would seek to to pardon service members accused or convicted of war crimes, direct involvement by Mukasey in a case revolving around an accused war criminal raised some eyebrows.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When a reporter asked about the potential conflict of interest arising with Mukasey\u2019s involvement, Parlatore responded, \u201cYou want to make a motion on that?\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Minutes later, he backtracked to the question.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cMarc Mukasey has not talked to the president about this,\u201d he said. \u201cThat\u2019s not what he\u2019s doing here, and if the president chooses to act, it will be on his own.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mukasey, meanwhile, dismissed the connection, telling Military Times he was joining the case specifically to represent Gallagher as his trial lawyer. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI joined the Gallagher team to win the case in the courtroom and that\u2019s what we\u2019re focused on,\u201d he said. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gallagher\u2019s defense team has filed a motion calling for the case to be dismissed, Parlatore said previously. And on Wednesday, he also pushed for a rewording of the judge\u2019s gag order issued earlier this year, which prohibited lawyers from sharing court documents with the press. Parlatore claimed that leaks to the press have only benefited the prosecution, putting the defense in a position in which, according to the gag order, they are unable to respond to the leaked claims made.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Navy\u2019s top spokesman, Capt. Greg Hicks, declined to comment on the email device targeting Navy Times but acknowledged that the the Naval Criminal Investigative Service is conducting &#8220;an ongoing investigation into the unauthorized disclosure of information covered by a judge\u2019s protective order.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe most troubling thing about this whole situation is that it\u2019s being conducted by NCIS, when they were the source of the leaks to begin with,&#8221; Parlatore said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gallagher\u2019s trial, which was scheduled to begin May 28, has been postponed. The next hearing is scheduled for May 27.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is expected that the case, by then, will involve an independent computer expert to extract any available detailed information from the IP addresses that were provided to the judge in number form, a document the judge referenced as \u201cjust a page of numbers. It\u2019s my understanding those numbers are meaningless.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Any recusal motion from Gallagher\u2019s team must be submitted to the court by Friday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In addition to the charges lodged against Gallagher, Gallagher\u2019s platoon\u2019s commanding officer, <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2019\/04\/11\/more-legal-bombshells-explode-in-war-crimes-case\/\">Lt.
