{"id":28101,"date":"2020-11-01T16:55:15","date_gmt":"2020-11-01T16:55:15","guid":{"rendered":"https:\/\/one.sightlinemg.com\/navytimes\/uncategorized\/2020\/11\/01\/naval-academy-midshipman-asks-judge-to-block-his-removal-over-tweets\/"},"modified":"2026-08-08T19:27:44","modified_gmt":"2026-08-08T19:27:44","slug":"naval-academy-midshipman-asks-judge-to-block-his-removal-over-tweets","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2020\/11\/01\/naval-academy-midshipman-asks-judge-to-block-his-removal-over-tweets\/","title":{"rendered":"Naval Academy midshipman asks judge to block his removal over tweets"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">COLLEGE PARK, Md. \u2014 Chase Standage, a U.S. Naval Academy <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2020\/10\/02\/midshipman-sues-naval-academy-over-discipline-for-tweets\/\" target=_blank>midshipman facing expulsion <\/a>over social media posts, sees himself as a casualty of a campus \u201cculture war.\u201d Academy leaders say the damage to his military career was self-inflicted.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An academy official recommended disenrolling the white midshipman for <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2020\/06\/18\/naval-academy-opens-investigation-into-midshipmans-social-media-posts\/\" target=_blank>tweeting a flurry of crude messages<\/a>, including one in which he said Breonna Taylor received \u201cjustice\u201d on the day police in Louisville, Kentucky, killed the Black woman during a drug raid.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But a federal judge in Maryland ultimately could decide whether the 21-year-old California native has a future as a naval officer and pilot. U.S. District Judge Ellen Hollander didn\u2019t immediately rule on Friday after presiding over a hearing on Standage\u2019s request for a court order allowing him to finish his senior year and graduate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judge said Standage\u2019s posts were \u201cdistasteful at best\u201d and demonstrated poor judgment, but she questioned why he faces \u201cthe most draconian sanction he could get\u201d when the academy explicitly permits midshipmen to express their personal opinions on social media.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt appears that people in charge didn\u2019t like his point of view. Not the way he said it but what he said,\u201d Hollander said.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2020\/10\/02\/midshipman-sues-naval-academy-over-discipline-for-tweets\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"207\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/AP_957279859073.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Midshipman sues Naval Academy over discipline for tweets<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Midshipman 1st Class Chase Standage, 21, says in the lawsuit that the academy is violating his constitutional rights of free speech and a fair and impartial hearing.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Standage sued to block his separation from the academy, claiming it violated his First Amendment right to freely express his views. His lawsuit also claims academy leaders violated his Fifth Amendment right to due process, denying him a fair and impartial disciplinary hearing. He is accused of violating academy rules governing political activity and of engaging in conduct unbecoming a midshipman.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hollander expressed doubt that she will rule before the academy\u2019s semester ends on Dec. 12. She previously ruled that Standage could remain at the academy while his lawsuit is pending.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis case is the kind of case that keeps you up at night when you\u2019re a judge,\u201d she said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The son of two Los Angeles Police Department officers, Standage says he feared for their safety during the week in June when he posted the tweets in question.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWhy is it taking so long for Breonna Taylor to receive her justice?\u201d a Twitter user posted in June.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cHer justice was received on March 13, 2020,\u201d Standage replied, referring to the day of the deadly raid.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Academy investigators also singled out several other tweets in which Standage advocated using lethal force against civilians.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAll it takes is one drone strike,\u201d he tweeted in response to another user\u2019s post about \u201cantifa extremists\u201d in Seattle.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Standage posted under the username \u201cCheese Sandwich\u201d and didn\u2019t identify himself as a midshipman in the posts, but his Twitter handle was @ChaseStandage. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hollander expressed concern that Standage\u2019s discipline will have a chilling effect on the free speech of other midshipmen.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI am not condoning or endorsing what he said, but there is a larger issue here,\u201d the judge said. \u201cWhere does the student know what would be deemed unprofessional? Where is that outlined? Because it seems like it\u2019s totally subjective.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Standage\u2019s attorney, Jeffrey McFadden, said other midshipmen with different views than Standage routinely violate the same standards without any consequences.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt\u2019s a deeply flawed process,\u201d McFadden said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">An academy official who recommended Standage\u2019s removal said the midshipman \u201clost my confidence in his ability to make sound decisions and to uphold the core values expected from an officer in the Navy.\u201d The court temporarily suspended Standage\u2019s disciplinary process after he sued on Sept. 30.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A government lawyer urged the judge to throw out the lawsuit. Assistant U.S. Attorney Kelly Marzullo said the courts must show \u201cgreat deference\u201d to the judgment of military authorities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIn this case, a military commander is better situated to evaluate whether comments that advocate for the use of airstrikes against civilians dishonor or disgrace an aspiring naval aviator and compromise his standing as an officer,\u201d Marzullo wrote in a court filing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Standage\u2019s lawsuit claims the academy is waging a culture war \u201cthat not only mirrors the broader culture war at which the country currently finds itself, but one that is exacerbated by the unprecedented external stressor of the coronavirus pandemic and many midshipmen\u2019s reckless abuse of social media.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Like many other colleges and universities in the U.S., the Naval Academy has been grappling with questions about systemic racism within their institutions.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2020\/06\/07\/naval-academy-alumni-board-member-resigns-after-accidental-broadcast-of-racial-slurs-on-facebook\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"207\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/AP_957279859073.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Naval Academy alumni board member resigns after accidental broadcast of racial slurs on Facebook<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">A Naval Academy Alumni Association Board of Trustees member resigned from his position Saturday after an accidental Facebook Live video broadcast him and his wife making racist comments and using racial slurs while talking about the Black Lives Matter movement.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">In June, the Naval Academy rescinded an appointment to a Maryland student who posted racist, transphobic and sexist statements on the Discord instant messaging platform. That same month, a retired Navy captain  <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2020\/06\/07\/naval-academy-alumni-board-member-resigns-after-accidental-broadcast-of-racial-slurs-on-facebook\/\" target=_blank>resigned from the US Naval Academy Alumni Association board <\/a>after accidentally posting live video on social media of a conversation with his wife that included racist comments.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Vice Adm. Sean Buck, the Naval Academy\u2019s superintendent, said in a statement in September that he was \u201cnot naive in thinking that bigotry and racism do not exist, to some extent, within our Naval Academy family.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Buck and Navy Secretary Kenneth Braithwaite are named as defendants in Standage\u2019s lawsuit. The suit describes Buck as \u201ca true believer in the woke culture and its insistence that \u2018systemic\u2019 racism permeates the Naval
