{"id":31782,"date":"2019-07-15T20:36:16","date_gmt":"2019-07-15T20:36:16","guid":{"rendered":"https:\/\/one.sightlinemg.com\/navytimes\/uncategorized\/2019\/07\/15\/one-sailor-dead-another-charged-with-murder-as-investigation-widens\/"},"modified":"2026-08-08T19:13:48","modified_gmt":"2026-08-08T19:13:48","slug":"one-sailor-dead-another-charged-with-murder-as-investigation-widens","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2019\/07\/15\/one-sailor-dead-another-charged-with-murder-as-investigation-widens\/","title":{"rendered":"One sailor dead, another charged with murder as investigation widens"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">PORTSMOUTH, Va. \u2014 They were two sailors with different ratings, off of two different aircraft carriers, who didn\u2019t even seem to know each other when an argument broke out inside a two-story home along Atlanta Avenue here.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It was shortly before 9:00 p.m. on May 5, and by the time the evening ended one would be dead and the other the target of a manhunt that eventually involved two police departments and the Navy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It was four days before Aviation Ordnanceman Airman Dalen O\u2019Shay Spence turned 22, but now he faces charges of first-degree murder and using a firearm during the commission of a felony following the shooting death of Machinist\u2019s Mate (Nuclear) 3rd Class Donald Alton Thorington, 23.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Spence has yet to enter a plea, but he told authorities he was defending himself from a larger sailor who attacked him. A bodybuilder, Thorington was 6 foot 1 inch tall and tipped the scales at 270 pounds \u2014 twice the weight of Spence and 9 inches taller, according to court filings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Detectives, however, suspect Spence could\u2019ve evaded the unarmed Thorington and instead gunned him down and left him to bleed out near the street.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ongoing criminal probe has escaped the media spotlight, perhaps because it capped off a bloody weekend for the sea service here.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The night before and less than a mile from Thorington\u2019s home, a corpsman shot himself to death <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2019\/05\/07\/police-three-sailors-dead-in-apparent-murder-suicide-shooting\/\">after killing two female sailors <\/a>in front of a 7-Eleven convenience store, authorities say.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That case also remains under investigation.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2019\/05\/08\/one-sailor-dead-another-behind-bars-following-second-portsmouth-shooting\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"152\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Dalen-Spence.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">One sailor dead, another behind bars following second Portsmouth shooting<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Two shootings over the weekend less than a mile apart in Portsmouth claim the lives of four sailors.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Originally from upstate New York, Thorington enlisted in the Navy in early 2015 and at the time of his death was assigned to the aircraft carrier George Washington, according to his service records.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s undergoing a midlife refueling and overhaul at Huntington Ingalls Newport News Shipyard near here.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He lived at 1312 Atlanta Ave. with three roommates and they were having a party on May 5, court filings obtained by Navy Times indicate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A case summary drafted by Portsmouth Police Department Detective W.J. Baker begins with a verbal argument that erupted inside the residence and soon turned physical.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The alleged instigators were asked to leave but the spat followed them outside, where \u201cthe argument intensified and there was a lot of yelling and punches were being thrown by both sides,\u201d Baker wrote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Standing on the sidewalk, Thorington was jawing with Harrison White, a 20-year-old Norfolk resident who attended the party. Thorington told White \u201cto come to him,\u201d Baker wrote, but before he could comply Spence stepped in front of him and \u201cpulled his gun out of the holster\u201d and pointed it at the bodybuilder.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Originally from North Carolina, Spence had enlisted in early 2017 and was assigned to the aircraft carrier George H.W. Bush, which is undergoing maintenance at Norfolk Naval Shipyard here.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In Baker\u2019s version of events, Thorington asked Spence, \u201cWhat are you going to do with the gun?\u201d before he moved toward Spence and \u201cgrabbed his neck.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Spence then fired twice, striking Thorington in the chest and the \u201cstomach area,\u201d according to Baker\u2019s report.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Spence, White and others who\u2019d been urged to leave the party \u201cquickly got in their vehicles&#8221; and left a scene that had descended into chaos, with Baker noting that \u201cit was still undetermined\u201d by those in the house \u201cwho in the group shot\u201d Thorington.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Police officers arrived to find Thorington dying in his front yard, his friends frantically doing cardio-pulmonary resuscitation to save him.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Paramedics rushed him to <a href=\"https:\/\/www.sentara.com\/hospitalslocations\/locations\/sentara-norfolk-general-hospital.aspx\" target=_blank>Sentara Norfolk General Hospital<\/a>, where he was pronounced dead.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The coroner later ruled Thorington\u2019s death a homicide caused by \u201cmultiple gunshot wounds.&#8221;<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"5476\" height=\"3651\" src=\"\/wp-content\/uploads\/2026\/08\/DSC_1594.jpg.jpg\" alt=\"\" class=\"wp-image-62977\" srcset=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/DSC_1594.jpg.jpg 5476w, https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/DSC_1594.jpg.jpg?resize=300,200 300w, https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/DSC_1594.jpg.jpg?resize=768,512 768w, https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/DSC_1594.jpg.jpg?resize=1024,683 1024w, https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/DSC_1594.jpg.jpg?resize=1536,1024 1536w, https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/DSC_1594.jpg.jpg?resize=2048,1365 2048w\" sizes=\"auto, (max-width: 5476px) 100vw, 5476px\" \/><figcaption class=\"wp-element-caption\">The front of 1312 Atlanta Street in Portsmouth, Virginia, where Machinist&#8217;s Mate MM3 Donald Thorington was shot by Aviation Ordnanceman Airman Dalen Spence who is claiming self defense. Faram\/staff)<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Police officers soon realized that none of those who remained at the house actually witnessed the shooting but they were able to gather some of the names of those who drove away, Baker wrote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They also found a key piece of physical evidence \u2014 a spent .40 caliber casing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Authorities eventually tracked down eyewitnesses, but it was White who told police that \u201cDuce\u201d \u2014 his name for Spence \u2014 pulled the trigger.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a statement tucked into the court records, White also said that nothing blocked his or Spence\u2019s \u201cpath to retreat.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Multiple messages left with White by Navy Times were not returned and he has yet to testify under oath in a courtroom.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On May 7, two days after the shooting, Naval Criminal Investigative Service agents boarded the aircraft carrier George H.W. Bush to take Spence into custody.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">NCIS spokesman Ed Buice told Navy Times that the probe became a joint investigation with the Portsmouth Police Department and once Spence was identified his agency issued a BOLO \u2014 be on the lookout \u2014 alert for base security and his carrier.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">NCIS agents then handed him over to the Portsmouth Police and he was interviewed by Detective Stanley Alexander, according to a search warrant affidavit issued in Norfolk Circuit Court later that day.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Spence allegedly told Alexander that he shot Thorington with a .40 caliber <a href=\"https:\/\/www.smith-wesson.com\/\" target=_blank>Smith &amp; Wesson <\/a>handgun \u201cto protect himself the night of the shooting,\u201d according to the filing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The affidavit indicates that Spence said he kept the firearm locked up alongside a semiautomatic firearm styled like a Military Armament Corporation Model 10 pistol inside his apartment at 529 W. 24th St. in Norfolk, where he resided with two roommates.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When police searched the apartment later that day, they found the two weapons Spence described, plus a Colt M1911 .45 caliber pistol and a Cobray 9mm semiautomatic pistol styled like a Military Armament Corporation Model 11, according to a court filing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They also recovered a plastic holster, two gun boxes, loaded magazines and the lower portion of a Sig Sauer pistol, the warrant\u2019s index revealed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The documents reveal that authorities also confiscated $1,489 in cash, a digital scale, 132 grams of what they suspect is marijuana, another 25 grams of what they called an \u201cunknown white powder\u201d and two capsules believed to be the narcotic Xtampza ER \u2014 extended release oxycodone.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">NCIS later confirmed that the agency assisted local authorities in the search.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Amanda Howie \u2014 the spokeswoman for the <a href=\"https:\/\/www.norfolk.gov\/index.aspx?NID=577\" target=_blank>Office of the Norfolk Commonwealth\u2019s Attorney<\/a> \u2014 told Navy Times that she was \u201cfamiliar with this overall matter\u201d but declined to discuss details.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">She later added that Spence \u201cis not currently a defendant charged in a case pending prosecution by this office\u201d and that she had \u201cno additional information to provide at this time.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It remains unclear if Spence had been issued a permit to carry a concealed weapon in Virginia. Kirkman\/Navy)<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Spence was arraigned on May 7 in Portsmouth General District Court on the homicide and firearms charges.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He initially was denied bail due to the seriousness of the allegations, but all that changed after the sailor retained defense attorneys Michael Massie and Nathan Chapman of Portsmouth\u2019s <a href=\"http:\/\/chapmanlawfirm.org\/\" target=_blank>Chapman Law Firm<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On May 13 he was released on a $35,000 surety bond guaranteed by Walt\u2019s Bail Bonds in nearby Chesapeake. But the next day the bondsman asked \u201cto be removed from the bond, due to paperwork issues\u201d and Spence was returned to custody, court documents indicate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During a second bail hearing held on May 21, Circuit Judge Kenneth Melvin cited Spence\u2019s family ties to nearby Elizabeth City, North Carolina, and duty with the Navy as reasons to release him, this time on a $100,000 bond, according to court documents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The records reveal no reason why the sum changed, but the bail was put up by Christopher Bell of the <a href=\"https:\/\/stuckinjail.com\/listing-bunch-bail-bonding-co-serving-portsmouth-city-jail-va-2165584426\" target=\"_blank\">Bunch Bail Bonding Co.<\/a> in Chesapeake.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When reached by phone, Bell confirmed he backed the bond, based on an agreement struck with Daniel O\u2019Shay Spence \u2014 Dalen\u2019s father \u2014 a Baptist minister in Elizabeth City.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Citing confidentiality concerns, both Bell and the elder Spence declined to specify the collateral for the bond, but Spence has been out ever since.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">By granting bail, Melvin overruled the request of Michele Burton, the <a href=\"https:\/\/www.portsmouthcwa.com\/\" target=_blank>Commonwealth\u2019s Attorney<\/a> in Portsmouth prosecuting the case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But Melvin also ordered Spence to avoid contact with witnesses, subject himself to random drug and alcohol tests, remain at his Navy job and possess no firearms or other weapons while living with his parents in North Carolina.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Citing the ongoing probe, Burton\u2019s spokesman \u2014 Deputy Commonwealth\u2019s Attorney Brandon T.
