Kuchta was relieved Sept. 19 \u201cdue to a loss of confidence in Kuchta\u2019s ability to perform the duties of a command senior enlisted advisor,\u201d the Cape Canaveral-based unit\u2019s spokeswoman, April Crew-Kelly, said in an email.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While Navy officials did not provide specifics regarding Kuchta\u2019s relief, it followed his arrest by Brevard County Sheriff\u2019s deputies on Sept. 18 after Kuchta was accused of assaulting another man before he resisted arrest and was tased, according to law enforcement records.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Reached by phone Monday, Kuchta, 41, disputed law enforcement\u2019s description of what happened on the evening of Sept. 18 in a <a href=\"https:\/\/www.cityofrockledge.org\/\" target=_blank>Rockledge<\/a> neighborhood and said he was only defending himself.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kuchta faces misdemeanor charges of property theft and resisting arrest without violence, according to court records.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2020\/07\/08\/navy-fires-eod-command-master-chief\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"157\" unclear.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">He also faced a misdemeanor battery charge and a felony robbery charge, but prosecutors withdrew those last week, court records show.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sheriff\u2019s office officials did not return calls this week seeking more information about the encounter.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Officials with Florida\u2019s 18th Judicial Circuit, which covers Brevard County, also declined to comment on the case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But circuit spokesman Todd Brown said that, in general, \u201cevery complaint that our office receives undergoes a careful and thorough review by experienced prosecutors to determine if they reasonably believe the alleged crimes can be proven beyond a reasonable doubt at trial.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Such a standard is \u201cmuch higher\u201d than the probable cause standard met by law enforcement when arresting a defendant, Brown said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Deputies arrived to the 1700 block of Clubhouse Drive at about 8:30 p.m. on Sept. 18, according to a deputy\u2019s affidavit entered in Kuchta\u2019s Brevard County court file.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There, Kuchta \u201cappeared to be under the influence of alcohol\u201d because \u201chis eyes were glossy and his speech was slurred,\u201d according to the affidavit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI detected the impurities of alcohol coming from his person,\u201d the deputy wrote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The officer wrote that Kuchta had punched an unidentified victim, and that \u201cthe victim was bleeding heavily from his head upon deputy\u2019s arrival.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The deputy also wrote that Kuchta took the victim\u2019s iPhone, shirt and shoes, and that Kuchta \u201cdiscarded the victim\u2019s shirt and shoes in a nearby pond,\u201d the report states.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The report also alleges that when deputies attempted to ask Kuchta about the incident, \u201che refused to cooperate and began shouting.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At one point, Kuchta attempted to pull away when they tried to handcuff him, according to the report.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe defendant was escorted to the ground where he continued to resist until he was ultimately tased and placed in handcuffs,\u201d the deputy wrote.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link said.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Deputies found the alleged victim\u2019s iPhone on Kuchta and he told them he was keeping it as \u201ccollateral,\u201d the report states.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When paramedics attempted to assess any injuries to Kuchta, he refused care \u201cand told them to \u2018go (expletive) yourselves,\u2019\u201d the deputy wrote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Reached by phone Monday, Kuchta said \u201ca big part of the story\u201d had been left out.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kuchta told Navy Times he was riding with his girlfriend back to his house in her golf cart that evening.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At a crosswalk, Kuchta said he pulled her keys out of the golf cart\u2019s ignition and that she protested, but that they were joking around.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kuchta escribedthe udnidentified victim in the police report as \u201ca concerned citizen\u201d who came to check on Kuchta\u2019s girlfriend, but she told him they were fine, according to the master chief.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The unidentified man started grabbing him and wouldn\u2019t stop, Kuchta said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The man eventually pulled him from the golf cart, tackled him and was on his chest, according to Kuchta.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI started fighting back,\u201d he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kuchta said his girlfriend has video of the encounter, but he declined to provide a copy to Navy Times, citing the ongoing case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At one point, Kuchta said, he told his girlfriend to go home and he then fled from the alleged victim and his friend, who were in their own golf cart and \u201ctrying to track me down.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He said he hid out in the woods about a half mile from his house until the police showed up.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThey were very aggressive from the get-go,\u201d Kuchta said of the responding deputies. \u201cThe other guy was very bloody, so they immediately assumed I was the aggressive one.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kuchta said he had the other man\u2019s phone because he was \u201ctrying to figure out who he was.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He alleged that the responding deputies were \u201cbrutal,\u201d and showed up \u201cguns a-blazing, ready to go.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI was hiding in the woods from the guys, I heard the megaphone from the (deputies&#8217;) car \u2026 they\u2019re screaming at me to put my hands up,\u201d said Kuchta, who added he hasn\u2019t filed a formal complaint against the deputies.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI have an attorney and am still looking at how to go forward,\u201d he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kuchta also took issue with the event being characterized as an \u201calcohol-related incident\u201d by the Navy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cMy issue is that I consumed three total drinks in four hours\u201d before the encounter, he said. \u201cThese were measured drinks. Two of them were beers.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI was attacked in my neighborhood, defending myself,\u201d Kuchta added. \u201cI\u2019m confident that, three drinks or zero drinks, I would\u2019ve reacted the same way.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kuchta objected to the Navy\u2019s assertion that he was relieved on Sept. 19, and said he was only relieved last week.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He said he doesn\u2019t \u201cfeel slighted by the command.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI love the Navy, I love my command, I\u2019ve been dedicated,\u201d he said. \u201cI completely understand that as a command master chief, I\u2019m held to a higher standard.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kuchta enlisted in 1997 and made master chief in 2015, according to service records.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He remains assigned to the NOTU, a unit that tests sea-based weapons systems.<\/p>\n\n\n\n<iframe loading=\"lazy\" width=\"200\" height=\"113\" src=\"https:\/\/www.youtube.com\/embed\/9Ax0yrYVcDs?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture\" allowfullscreen title=\"The end of tanks?
