Cmdr. Robert Breisch, warning him that they\u2019re probing his alleged involvement in a purported cover up of war crimes committed by a Navy chief.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A tool often found in the kits of U.S. Department of Justice prosecutors, target letters inform citizens that they will be called to testify before a secret federal grand jury <a href=\"https:\/\/www.justice.gov\/jm\/criminal-resource-manual-160-sample-target-letter\" target=_blank>exploring their potential wrongdoing<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the military doesn\u2019t have secret grand juries. Instead, military prosecutors make a case before an investigating officer at what\u2019s called an Article 32 hearing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The officer hearing the public case sifts through sworn testimony and other evidence and then forward recommendations about potential charges to a flag officer, who can decided to convene a court-martial or not.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Navy Times talked to six prominent defense attorneys and they\u2019d never heard of a target letter being used inside the criminal justice system of the armed forces.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But its issuance to Breisch \u2014 a troop commander at SEAL Team 7 in Iraq in 2017 \u2014 was disclosed in a Wednesday evening email sent to <a href=\"http:\/\/www.jeremiahsullivanlaw.com\/\" target=_blank>Jeremiah J. Sullivan III,<\/a> the attorney representing <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2019\/02\/02\/war-crimes-prosecution-against-navy-seals-takes-a-double-hit\/\" target=_blank>SEAL Lt. Jacob X. \u201cJake\u201d Portier<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The former commanding officer of SEAL Team 7\u2032s Alpha Platoon, Portier awaits court-martial trial at Naval Base San Diego this summer on allegations that he helped to cover up the murder of an Islamic State prisoner of war receiving medical care outside the Iraqi city of Mosul in 2017.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe sent a target letter to LCDR Breisch,\u201d wrote military prosecutor Cmdr. Christopher Czaplak. \u201cIf your client would like to proffer with us and resolve this case at NJP, please let me know soonest.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Proffers are legal documents that outline what potential witnesses will say on the stand in a court-martial trial in exchange for immunity from prosecution for crimes they also might\u2019ve committed.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2019\/02\/10\/legal-bombshells-explode-on-two-seal-war-crimes-cases\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"193\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/EddieIraq.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">New legal bombshells explode on two Navy SEAL war crimes cases<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Two SEALs offer up damaging testimony against a chief special warfare operator accused of war crimes &#8212; and suggest the command did not initially investigate the sprawling allegations of misconduct, new legal documents show.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Sullivan has long suspected that military officials charged Portier to force him to roll over on senior SEAL leaders. He has insisted the lieutenant knew nothing about the stabbing homicide allegedly committed by Special Warfare Operator Chief Edward \u201cEddie\u201d Gallagher \u2014 much less a pair of shootings that allegedly struck an elderly Iraqi man and a young girl.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sullivan contends Portier covered up nothing and was, in fact, <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2019\/04\/04\/seals-lawyered-up-during-war-crimes-case-then-prosecutors-went-after-their-lawyer\/\" target=\"_blank\">the person who first went to superiors <\/a>about the allegations when they surfaced<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a response, Sullivan asked Czaplak if prosecutors were sending target letters to senior enlisted leaders at Naval Special Warfare Group 1 and SEAL Team 7 who also <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2019\/02\/10\/legal-bombshells-explode-on-two-seal-war-crimes-cases\/\" target=_blank>have been accused of stonewalling an investigation<\/a> by junior sailors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He also accepted Czaplak\u2019s offer of administrative non-judicial punishment proceedings in front of <a href=\"https:\/\/www.navy.mil\/navydata\/bios\/bio.asp?bioID=812\" target=_blank>Rear Adm. Collin P. Green<\/a>, the commander of Naval Special Warfare, instead of going to court-martial, but voiced concerns about the prosecution\u2019s motives.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cLT Portier has always been willing to testify truthfully at NJP or trial,\u201d wrote Sullivan. \u201cHowever, we do not agree to make his NJP contingent upon the quality of his testimony at a proffer.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sullivan told Czaplak that Green can hear Portier out and then \u201cmake the call on his guilt\/innocence.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After that, Portier will then make himself available for further interviews with federal investigators and even a proffer, Sullivan offered.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Czaplak declined comment when contacted, pointing Navy Times to officials at Navy Region Southwest, the convening authority in both the Gallagher and Portier cases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe legal process is ongoing and, in order to ensure the integrity of the proceedings, it is imperative that the Navy decline to comment at this time,\u201d said Region spokesman Jay Delarosa.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2019\/04\/22\/what-motivated-fellow-seals-to-dime-out-eddie-gallagher\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"164\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Gallagher-Iraq-3.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">What motivated fellow SEALs to dime out Eddie Gallagher?<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The fog of war swirls through the reams of internal files provided to Navy Times.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Reached by phone in California, Breisch\u2019s attorney, <a href=\"https:\/\/www.attorney4people.com\/\" target=_blank>Joseph Low<\/a>, confirmed that his client received the target letter and said he was perplexed by its use in a military case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis is what happens when you charge first and ask questions later,\u201d said Low, who castigated the probes into Portier and Gallagher as a series of amateurish \u201cchecker moves, not chess.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Low said the target letter sent to Breisch was the latest example of the prosecutors\u2019 gamesmanship, which he compared to \u201ca drunk waving a gun in the bar.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWhen that round goes off, it\u2019s going to inevitably hit somebody, and it hit my client.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis has taken an incredible toll on Lt. Cmdr. Breisch,\u201d Low added. \u201cThese kinds of accusations harm someone personally but they also harm a family. They harm careers as well.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Low portrayed Breisch as a cooperative witness who tried to help prosecutors and Naval Criminal Investigative Service agents with their probes but now frets the target letter will block his client from testifying in both cases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/www.law.cornell.edu\/constitution\/fifth_amendment\" target=_blank>Fifth Amendment to the federal Constitution<\/a> prohibits witnesses from being forced to incriminate themselves while giving testimony in criminal proceedings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Breisch has not been provided immunity from prosecution in exchange for his testimony, unlike other witnesses tied to the probes.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"638\" height=\"829\" src=\"\/wp-content\/uploads\/2026\/08\/Gallagher-Iraq-1.jpeg.jpg\" alt=\"\" class=\"wp-image-32463\" srcset=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Gallagher-Iraq-1.jpeg.jpg 638w, https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Gallagher-Iraq-1.jpeg.jpg?resize=231,300 231w\" sizes=\"auto, (max-width: 638px) 100vw, 638px\" \/><figcaption class=\"wp-element-caption\">Special Warfare Operator Chief Edward \u201cEddie\u201d Gallagher in Iraq in 2017. (courtesy photo)<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Reached in New York, Gallagher\u2019s attorney, <a href=\"https:\/\/parlatorelawgroup.com\/\" target=_blank>Timothy Parlatore<\/a>, savaged the prosecution\u2019s use of a target letter to \u201csideline a key witness.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt is ironic and grotesque that my client has been charged with obstructing justice but the latest antics are exactly what the government did to Lt. Cmdr. Breisch,\u201d he said. &#8220;This is pure witness intimidation and obstruction of justice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIf the government does it, does that make it right?\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2019\/04\/24\/prosecutors-ncis-investigator-accused-of-misconduct-in-war-crimes-case\/\" target=_blank>a motion filed April 23 in California<\/a>, Parlatore accused both NCIS agents and military prosecutors of misconduct.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To Parlatore, prosecutors long ago lost sight of what a court-martial trial should be \u2014 the pursuit of what truly happened \u2014 and instead made it into a legal competition.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIf a trial is really about a search for the truth, they should want Lt. Cmdr. Breisch to testify. Instead, they\u2019re trying to make him invoke the Fifth Amendment,\u201d Parlatore said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In an interview with Navy Times last month, Parlatore predicted that the feds would move on Breisch to sideline him as a witness.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Now he wants the commander of Navy Region Southwest \u2015 Rear Adm. <a href=\"https:\/\/www.navy.mil\/navydata\/bios\/bio.asp?bioID=714\">Rear Adm. Bette Bolivar<\/a> \u2014 to extend immunity deals to Breisch and Portier so that they can testify honestly at Gallagher\u2019s court-martial trial, which is slated to begin May 28.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So for, however, she\u2019s been reluctant <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2019\/04\/16\/flag-no-special-immunity-for-seal-witnesses-in-war-crimes-case\/\" target=_blank>to expand immunity<\/a> for <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2019\/04\/16\/flag-no-special-immunity-for-seal-witnesses-in-war-crimes-case\/\" target=_blank>other witnesses in the case<\/a>, much less a
