{"id":41110,"date":"2018-08-29T21:59:47","date_gmt":"2018-08-29T21:59:47","guid":{"rendered":"https:\/\/one.sightlinemg.com\/navytimes\/uncategorized\/2018\/08\/29\/coast-guard-probe-finds-negligence-in-boat-tragedy\/"},"modified":"2026-08-08T19:42:44","modified_gmt":"2026-08-08T19:42:44","slug":"coast-guard-probe-finds-negligence-in-boat-tragedy","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2018\/08\/29\/coast-guard-probe-finds-negligence-in-boat-tragedy\/","title":{"rendered":"Coast Guard probe finds negligence in boat tragedy"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">KANSAS CITY, Mo. \u2014 The <a href=\"https:\/\/www.uscg.mil\/\" target=_blank>U.S. Coast Guard<\/a> has found probable cause that the sinking of a tourist boat on a Missouri lake last month that killed 17 people \u201cresulted from the misconduct, negligence, or inattention to the duties\u201d by the captain of the boat, according to a court motion filed Wednesday by federal prosecutors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The U.S. attorney\u2019s office also said in the motion that the captain of a second duck boat that made it safely to shore when the storm kicked up on <a href=\"https:\/\/www.visittablerocklake.com\/\" target=_blank>Table Rock Lake<\/a> near Branson on July 19 acted in a \u201cgrossly negligent manner.\u201d The filing doesn\u2019t elaborate on those findings.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the motion, prosecutors asked Kansas City federal court to issue an order that would delay attorneys involved in lawsuits related to the sinking from sharing information and evidence they gathered until the criminal investigation is complete.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Three federal lawsuits have been filed in the Western District of Missouri against the <a href=\"https:\/\/www.kansascity.com\/news\/state\/missouri\/article216232630.html\" target=_blank>duck boat<\/a> operators, including Ripley Entertainment, which owned the Ride the Ducks attraction at the lake.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2018\/08\/04\/is-the-coast-guards-icebreaker-project-doomed\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"165\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Polar1A.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Is the Coast Guard\u2019s icebreaker project doomed?<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Capitol Hill wrangling might shift money for a new icebreaker to President Donald Trump&#039;s border wall.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">U.S. Attorney Timothy Garrison and assistant U.S. attorneys Randall Eggert and Casey Clark argue in the motion that much of the same evidence, documents and witnesses will be part of the criminal investigation and lawsuits. They contend that attorneys in the lawsuits are not entitled to know the substance of the government\u2019s case while the investigation is underway and sharing of some evidence could undermine the criminal case.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They say the criminal case takes precedence over civil matters because of the public&#8217;s interest in knowing if criminal conduct led to the tragedy. The Coast Guard referred the investigation to federal prosecutors on Aug. 13. No criminal charges have been filed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prosecutors say their investigation involves people named in the lawsuits and others, including Capt. Kenneth McKee, who was piloting Stretch Boat 7, which sank, and Capt. Barry King, who was piloting Stretch Duck 54, which made it safely to shore. McKee didn&#8217;t immediately reply to a call seeking comment. Amy Midgett said the agency won&#8217;t comment on the pending criminal investigation. And Suzanne Smagala-Potts, a spokeswoman for Ripley Entertainment, said in a statement that the company continues to cooperate with authorities but won&#8217;t comment on the ongoing investigation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ride the Ducks of Branson offers tours that first drive on land before entering the lake for nearly 20-minute ride. Video and audio recovered after the boat sank showed the lake was calm when the boat went into the water but severe winds up to 70 mph began blowing suddenly and one boat, carrying 31 people, sank within minutes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the lawsuits, attorneys contend the duck boat operators ignored weather warnings that day and had long ignored consultants and others who
