Michael Gilday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Premeditated murder, attempted homicide, obstruction of justice and other charges against Gallagher, 40, collapsed at his July court-martial trial. He was convicted of the sole charge of posing in 2017 with the body of a dead Islamic State fighter near Mosul, Iraq, an allegation he never denied.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Obtained by Navy Times, the 14-page clemency package filed on Oct. 1 with the CNO by criminal defense attorney <a href=\"https:\/\/parlatorelawgroup.com\/\" target=_blank>Timothy Parlatore <\/a>urges Gilday to vacate the conviction and administer non-judicial punishment at the Pentagon for the photo infraction.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWhat\u2019s shocking about this case is that Chief Gallagher, at the tip of America\u2019s spear in combat, swore an oath to defend the Constitution of the United States against all enemies, and yet his constitutional rights were violated at every step of his case by the Navy,\u201d Parlatore told Navy Times.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cmdr. Nate Christensen, the CNO\u2019s spokesman, told Navy Times that a final decision on Gallagher\u2019s fate will be made \u201cby the end of October.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Navy Times obtained the clemency request from sources independent of both Gilday and Parlatore.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2019\/08\/02\/navy-orders-probe-into-judge-advocate-general-corps-leaders\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Gallagher-sentence-2.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Navy orders probe into actions of Judge Advocate General Corps leaders<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Chief of Naval Operations Adm. John Richardson also dismissed all charges against a SEAL officer charged with covering up war crimes and stopped the ongoing probe of another special operator who confessed to murdering a detainee in Iraq in 2017.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">After acquitting him of all but the photograph charge the previous day, a panel of Gallagher\u2019s military peers on July 3 recommended the chief be reduced to petty officer first class, forfeit $2,697 of pay per month for four months and be confined to the brig for four months, half of what he\u2019d already spent in pretrial confinement in San Diego.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under Navy regulations, however, he\u2019s slated to be automatically demoted to the pay grade of E-1 for receiving a sentence of confinement following a general court-martial.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gilday catches the case because his predecessor, Adm. John Richardson, removed all court-martial authority from Navy Region Southwest for Gallagher, making the CNO the convening flag officer for post-sentencing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Two days earlier, Richardson had ordered authorities in San Diego<a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2019\/08\/02\/navy-orders-probe-into-judge-advocate-general-corps-leaders\/\" target=_blank> to dismiss all charges against Lt. Jacob X. \u201cJake\u201d Portier, <\/a>the officer in charge of Gallagher\u2019s Alpha Platoon, SEAL Team 7, in Iraq, for allegedly helping his chief cover up the war crimes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He also nixed an ongoing probe into Special Warfare Operator 1st Class Corey Scott, the SEAL petty officer who confessed on the witness stand during Gallagher\u2019s trial to killing the prisoner so that he wouldn\u2019t be tortured to death later by Iraqi forces.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Scott was provided immunity from prosecution in exchange for his testimony and can\u2019t be tried.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Richardson was so concerned about the ethics, competence and training of Navy attorneys that he ordered a worldwide review into the sea service\u2019s Judge Advocate General Corps, <a href=\"https:\/\/www.militarytimes.com\/news\/your-navy\/2019\/08\/22\/navsec-orders-comprehensive-review-of-navy-marine-corps-jags\/\" target=_blank>a probe later expanded <\/a>by Secretary of the Navy <a href=\"https:\/\/www.navy.mil\/navybio_ldr.asp?id=1001\" target=_blank>Richard V. (Photo provided)<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">In his clemency appeal, Gallagher claims that his \u201cdraconian punishment\u201d began long before the Navy\u2019s case against him fizzled at trial.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Slated for advancement to senior chief before the war crimes probe kicked off, his elevation was put on hold.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nominated for the Silver Star medal for battlefield valor, his award submission was tossed out and officials removed him as an instructor at Special Operations Urban Combat School.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During a June 20, 2018, Naval Criminal Investigative Service agents raid on his Point Loma home, his children were marched out onto the lawn by gunpoint, wearing only their underwear, according to sworn testimony by NCIS Special Agent Brian Frank at Gallagher\u2019s trial.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Contacted by Navy Times, NCIS officials declined comment on Sunday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They previously had assured Navy Times that the humiliation of Gallagher\u2019s children never happened, citing as proof video footage that apparently never existed, statements later contradicted during the trial by Frank.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Gallagher was denied treatment for traumatic brain injuries while locked away in Naval Consolidated Brig Miramar, Parlatore wrote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After eight combat deployments, the highly decorated Gallagher has 18 documented brain injuries in his medical files, according to the clemency request.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While behind bars, Gallagher\u2019s children were \u201cforced to wear robes to visit him because of all the sex offenders in the same brig,\u201d it continued.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">President Donald J. Trump ordered Gallagher released from the brig on March 30. (Navy)<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Gallagher is the only U.S. service member in nearly two decades of war in Afghanistan and Iraq convicted of the crime of appearing in a photo with a dead enemy, Parlatore wrote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That\u2019s because it\u2019s an offense that normally is adjudicated administratively with a counseling statement or non-judicial punishment, not a general court-martial trial.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe ended up here, with this clemency request, only because the government never did a real investigation about what happened in Iraq,\u201d Parlatore told Navy Times. \u201cAt a minimum, they owed everyone a proper investigation and to treat Chief Gallagher fairly.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At least 10 other service members assigned to the SEAL platoon also appeared in the photo with Gallagher, including a commissioned officer, Navy Lt. Thomas MacNeil.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After the group shot, he and other SEALs had their portraits taken with the corpse, too. The Navy charged none of them with the same crime or apparently even punished them administratively.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A longstanding Navy tradition shields junior sailors from receiving more severe punishment than a senior for offenses arising from the same incident, a custom designed to preserve accountability in a chain of command, Parlatore wrote.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2019\/07\/31\/trump-nixes-nams-for-4-prosecutors-tied-to-seal-case\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"152\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Trump-Gard2.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Trump nixes NAMs for 4 prosecutors tied to SEAL case<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">It&#039;s not the first time a tweeting Trump has interjected himself into the case.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">CNO Gilday will be forced to confront other uncomfortable truths unearthed by the Gallagher case, including a different NCIS agent conceding that he violated numerous procedures throughout the probe and had his testimony challenged by SEAL eye witnesses; agents who failed to obtain basic evidence from the sites where the crimes allegedly occurred; and allegations that investigators failed to even interview several witnesses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Part of the military judge\u2019s punishment for NCIS and prosecutorial misconduct included booting Cmdr. Christopher Czaplak, the lead prosecutor, from the case for <a href=\"https:\/\/www.navytimes.com\/news\/2019\/06\/04\/lead-navy-prosecutor-in-seal-war-crime-case-out-over-email-spying\/\">a warrantless surveillance program<\/a> cooked up with NCIS agents <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2019\/05\/13\/defense-attorneys-for-navy-seal-accused-of-war-crimes-say-prosecutors-spied-on-them\/\">to track emails sent by defense attorneys and Navy Times.<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He also was accused of hiding evidence that could have helped to clear Gallagher from some charges, even shielding it from his fellow prosecutors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Officials at the Office of the Judge Advocate General did not respond to requests for comment from Navy Times.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If Gilday lets Gallagher\u2019s verdict or punishment stand, Parlatore could push the clemency request up the chain to the highest levels of the Pentagon or the commander in chief, Trump.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But he says he and Gallagher haven\u2019t contemplated that.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI want to see what happens and then the client will decide,\u201d Parlatore said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><b>Clarification: <\/b>This story has been updated to remove the clemency appeal\u2019s paraphrase about Lt.
