Bryce Benson<\/a>\u2019s attorney told Navy Times.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Cmdr. Justin Henderson said that officials notified him and Benson about the BOI on Friday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The tribunal will weigh whether Benson should be separated for misconduct or substandard job performance, but Henderson said they weren\u2019t told which track the BOI will take.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to Navy regulations, a BOI offers officers a hearing so they can rebut allegations that could cause them to be separated from the service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">News of the upcoming BOI <a href=\"https:\/\/taskandpurpose.com\/fitzgerald-captain-board-inquiry\" target=_blank>was published first<\/a> by Task and Purpose.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2019\/04\/11\/navy-expected-to-drop-criminal-charges-against-fitzgerald-skipper\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"210\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/co_cdr-benson.JPG.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Navy drops all criminal charges against commander, junior officer in Fitzgerald collision cases<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The CO at the time of the 2017 collision and another junior officer will have charges dismissed Thursday, according to defense attorneys and families of the fallen.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Benson\u2019s BOI comes in the wake of the Navy\u2019s April 11 announcement that it was dropping criminal charges against Benson, who was awaiting a court-martial trial for dereliction in the performance of duties through negligence resulting in death and improper hazarding of a vessel.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Navy\u2019s legal retreat followed a military judge\u2019s ruling that then-Chief of Naval Operations Adm. John Richardson and former VCNO Adm. Bill Moran had committed <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2019\/04\/11\/in-the-aftermath-of-the-fitzgerald-collision-months-of-legal-fury-end-in-a-whimper\/\" target=_blank>unlawful command influence<\/a> during Benson\u2019s case, thanks to public statements they made about his purported guilt.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before Benson faced court-martial, he had been disciplined administratively in connection to the collision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cLike all of the Navy\u2019s other decisions in this case, this news is disappointing,\u201d Henderson said of the BOI notification.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Chief of Navy Personnel spokeswoman Capt. Amy Derrick declined to comment on the development.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cBecause of privacy concerns, we do not comment on individual personnel matters,\u201d she said in an email to Navy Times.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Benson hit the 20-year retirement mark in May and also awaits a medical retirement due to injuries he sustained in the 2017 mishap, Henderson said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A commercial vessel, the ACX Crystal collided with the Fitz off Japan on June 17, 2017, tearing into Benson\u2019s quarters while he was asleep there.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Benson suffered a head injury and had to be evacuated from the warship for medical care.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2019\/01\/14\/worse-than-you-thought-inside-the-secret-fitzgerald-probe-the-navy-doesnt-want-you-to-read\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"179\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/FITZMAIN2.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Worse than you thought: inside the secret Fitzgerald probe the Navy doesn\u2019t want you to read<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">It was kept secret from the public in part because it was designed to prep the Navy for potential lawsuits in the aftermath of the accident.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">An adverse ruling by the board could force Benson to retire as a lieutenant commander, which would trim his retirement pay.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Navy Secretary Richard V. (Photo provided to Navy Times)<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">In a rebuttal, Benson argued he made the most prudent decisions he could while leading the destroyer, even as the crew grappled with systemic challenges that dogged other warships in the Japan-based 7th Fleet.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A number of investigations \u2014 including <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2019\/01\/14\/worse-than-you-thought-inside-the-secret-fitzgerald-probe-the-navy-doesnt-want-you-to-read\/\" target=_blank>a scathing internal probe<\/a> obtained by Navy Times \u2014 pummeled the sea service for manning shortages, maintenance delays and a frenzied tempo of operations in the Fitz\u2019s destroyer squadron and across the Japan-based 7th Fleet.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Henderson said \u201cthere is no chance there will be any finding adverse\u201d to Benson at his BOI.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cHe didn\u2019t commit any misconduct,\u201d Henderson said. \u201cAs he\u2019s explained in response to the secretary\u2019s letter of censure, his actions in command were reasonable under the circumstances.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Navy dropped criminal charges against Cmdr.
