{"id":45371,"date":"2022-09-27T18:18:08","date_gmt":"2022-09-27T18:18:08","guid":{"rendered":"https:\/\/one.sightlinemg.com\/navytimes\/uncategorized\/2022\/09\/27\/navy-engineer-wife-plead-guilty-in-submarine-spy-case-again\/"},"modified":"2026-08-08T19:55:09","modified_gmt":"2026-08-08T19:55:09","slug":"navy-engineer-wife-plead-guilty-in-submarine-spy-case-again","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2022\/09\/27\/navy-engineer-wife-plead-guilty-in-submarine-spy-case-again\/","title":{"rendered":"Navy engineer, wife plead guilty in submarine spy case \u2014 again"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">CHARLESTON, W.Va. \u2014 A U.S. Navy nuclear engineer and his wife entered new guilty pleas Tuesday in a case involving <a href=\"https:\/\/www.navytimes.com\/news\/your-military\/2021\/10\/10\/navy-nuclear-engineer-charged-with-trying-to-pass-secrets\/\" target=\"_blank\">an alleged plot to sell secrets about nuclear-powered warships<\/a>, a month after their previous plea agreements that had called for specific sentencing guidelines were rejected.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.militarytimes.com\/news\/2021\/12\/08\/couple-accused-in-navy-submarine-spy-case-wanted-to-leave-us-because-of-trump-lawyer-says\/\" target=\"_blank\">Jonathan and Diana Toebbe of Annapolis, Maryland<\/a>, pleaded guilty in federal court in Martinsburg, West Virginia, to one felony count each of conspiracy to communicate restricted data.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">U.S. District Judge Gina Groh last month <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2022\/08\/16\/judge-rejects-navy-engineers-plea-agreement-in-submarine-spy-case\/\" target=\"_blank\">rejected the couple\u2019s initial pleas to the same charges<\/a>, saying the sentencing options were \u201cstrikingly deficient\u201d considering the seriousness of the case. The couple then immediately withdrew their initial guilty pleas and Groh set trial for January.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The previous sentencing range agreed to by lawyers for Jonathan Toebbe had called for a potential punishment between roughly 12 years and 17 years in prison. Prosecutors said Tuesday that such a sentence would be one of the most significant imposed in modern times under the Atomic Energy Act of 1954. Prosecutors also sought three years for Diana Toebbe.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under the latest plea agreement entered Tuesday before U.S. Magistrate Judge Robert Trumble, the couple would each face a maximum sentence of life in prison and a $100,000 fine, although prosecutors are asking for a sentence for Diana Toebbe at the lowest end of the guideline range.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/veterans\/2022\/07\/31\/coast-guard-veteran-held-without-bail-in-id-theft-mystery\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/AP22209020367301.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Coast Guard veteran held without bail in ID theft mystery<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Walter Glenn Primrose and his wife have been charged with stealing identities of two dead children.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">If the court doesn\u2019t accept the latest agreement, the defendants would again have the right to withdraw their guilty pleas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prosecutors said Jonathan Toebbe, 43, abused his access to top-secret government information and repeatedly sold details about the design elements and performance characteristics of Virginia-class submarines to someone he believed was a representative of a foreign government but who was actually an undercover FBI agent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Diana Toebbe, 46, who was teaching at a private school in Maryland at the time of the couple\u2019s arrest last October, was accused of acting as a lookout at several prearranged \u201cdead-drop\u201d locations at which memory cards containing the secret information were left behind.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The memory cards were devices concealed in objects such as a chewing gum wrapper and a peanut butter sandwich. The couple was arrested after he placed a memory card at a dead drop location in Jefferson County, West Virginia.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">None of the information was classified as top secret or secret, falling into a third category considered confidential, according to previous testimony.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The FBI has said the scheme began in April 2020, when Jonathan Toebbe sent a package of Navy documents to a foreign government and wrote that he was interested in selling to that country operations manuals, performance reports and other sensitive information. He included in the package, which had a Pittsburgh return address, instructions to his supposed contact for how to establish a covert relationship with him, prosecutors said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That package was obtained by the FBI in December 2020 through its legal attach\u00e9 office in the unspecified foreign country. That set off a monthslong undercover operation in which an agent posing as a representative of a foreign country made contact with Toebbe, ultimately paying $100,000 in cryptocurrency in exchange for the information Toebbe was offering.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The country to which he was looking to sell the information has not been identified in court documents and was not disclosed in court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prosecutors said the government has recovered classified information that Jonathan Toebbe had saved on electronic devices along with a \u201csubstantial amount\u201d of the cryptocurrency.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During a search of the couple\u2019s home, FBI agents found a trash bag of shredded documents, thousands of dollars in cash, valid children\u2019s passports and a \u201cgo-bag\u201d containing a USB flash drive and latex gloves, according to court testimony last year.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Diana Toebbe\u2019s lawyers at a December 2021 hearing denied prosecution assertions that cited 2019 messages exchanged by the couple in which she had <a href=\"https:\/\/www.militarytimes.com\/news\/2021\/12\/08\/couple-accused-in-navy-submarine-spy-case-wanted-to-leave-us-because-of-trump-lawyer-says\/\" target=\"_blank\">contemplated fleeing the United States to avoid arrest<\/a>.
