{"id":49499,"date":"2018-01-10T22:28:59","date_gmt":"2018-01-10T22:28:59","guid":{"rendered":"https:\/\/one.sightlinemg.com\/navytimes\/uncategorized\/2018\/01\/10\/with-state-approval-pending-ashford-gets-ok-to-keep-gi-bill-students\/"},"modified":"2026-08-08T08:05:44","modified_gmt":"2026-08-08T08:05:44","slug":"with-state-approval-pending-ashford-gets-ok-to-keep-gi-bill-students","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/navytimes\/education-transition\/2018\/01\/10\/with-state-approval-pending-ashford-gets-ok-to-keep-gi-bill-students\/","title":{"rendered":"With state approval pending, Ashford gets OK to keep GI Bill students"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Ashford University can continue enrolling students on the GI Bill \u2014 at least for now, the Veterans Affairs Department has confirmed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The online, for-profit school that\u2019s one of the top enrollers of military students <a href=\"https:\/\/www.militarytimes.com\/education-transition\/education\/2017\/07\/27\/gi-bill-ta-benefits-in-jeopardy-at-ashford-university\/\" title=\"\" class=\"\" target=\"_blank\">was in danger of losing its eligibility to accept GI Bill funds<\/a> last year after failing to maintain the appropriate state-level approval required for the veterans education benefit. That approval is still pending, but despite the VA\u2019s Jan. 9 deadline, the federal agency has decided not to pull payments as it awaits a court appeal and a decision from the state of California.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cOtherwise, Ashford likely would have sought a stay from the court, which, if granted, may well not have required Ashford to apply to (the California State Approving Agency for Veterans Education),\u201d VA spokesman Randy Noller said in an email. \u201cIn that event, VA would still be paying benefits and Ashford would not be undertaking any corrective actions.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After closing its only brick-and-mortar campus in Iowa in 2016, Ashford lost its approval from that state and opened a campus in Phoenix, receiving a sign-off from the Arizona State Approving Agency. But the VA <a href=\"https:\/\/www.militarytimes.com\/education-transition\/education\/2017\/11\/13\/ashford-universitys-gi-bill-eligibility-on-the-chopping-block-once-more\/\" title=\"\" class=\"\">said in a November notice to Ashford<\/a> that because the school\u2019s main campus is in San Diego, Arizona did not have jurisdiction to approve Ashford. The online for-profit school educates thousands of active-duty and veteran students each year.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Shortly after, Ashford filed an appeal in federal circuit court, disputing VA\u2019s interpretation of the law and arguing that unless the court intervenes, \u201cVA\u2019s precipitous and unlawful decision will force Ashford\u2019s veteran students to face an unpalatable set of choices.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The VA has moved to dismiss the case, VA Press Secretary Curt Cashour said Wednesday. The court could grant that dismissal in the next several months or choose to fully litigate the case, which could take about a year, he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Both Noller and Lauren Coartney, a spokeswoman for Ashford\u2019s parent company, Bridgepoint Education, told Military Times the VA has agreed not to suspend GI Bill benefits at the school until a court decides on the appeal. Ashford was also required to apply for state approval in California, which Coartney said the school has done.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Veterans Affairs Department \u201chas made assurances that as long as Ashford pursues this application in good faith, it will continue to pay benefits, even as Ashford and the VA remain in negotiation over approval in Arizona,\u201d Coartney said in an email.
