{"id":57055,"date":"2021-12-22T02:33:59","date_gmt":"2021-12-22T02:33:59","guid":{"rendered":"https:\/\/one.sightlinemg.com\/navytimes\/uncategorized\/2021\/12\/22\/hawaii-hearing-over-tainted-navy-water-ends-without-a-ruling\/"},"modified":"2026-08-08T09:34:23","modified_gmt":"2026-08-08T09:34:23","slug":"hawaii-hearing-over-tainted-navy-water-ends-without-a-ruling","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2021\/12\/22\/hawaii-hearing-over-tainted-navy-water-ends-without-a-ruling\/","title":{"rendered":"Hawaii hearing over tainted Navy water ends without a ruling"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">HONOLULU \u2014 A hearings officer expects to issue a recommendation early next week on whether the Navy has to comply with Hawaii\u2019s order to empty fuel from <a href=\"https:\/\/www.navytimes.com\/news\/your-navy\/2020\/10\/29\/navys-hawaii-fuel-tank-plan-rejected-by-state-epa\/\" target=\"_blank\">a massive storage tank facility <\/a>blamed for contaminating Pearl Harbor drinking water.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Navy is contesting an order by the state Department of Health to suspend the facility\u2019s operations and empty the underground tanks after tests in recent weeks detected petroleum in the Navy\u2019s <a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2021\/12\/13\/navy-dive-team-is-trying-to-remove-fuel-from-hawaii-water\/\" target=\"_blank\">tap water system<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Hearings officer David Day listened to hours of testimony and arguments into Monday night as the Navy tried to convince him that the emergency order isn\u2019t necessary while the state, along with Sierra Club of Hawaii and Honolulu\u2019s water utility, argued the tanks pose an imminent peril.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/management\/pay-benefits\/2021\/12\/21\/pentagon-ig-will-investigate-management-of-hawaii-fuel-storage-facility-at-center-of-water-crisis\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"214\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Red-Hill-Bulk-Fuel-Storage-Facility.Hirono-visit.-2015.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Pentagon IG will investigate management of Hawaii fuel storage facility at center of water crisis<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The investigation was requested by Hawaii&#039;s congressional delegation in light of the toxic water crisis at Joint Base Pearl Harbor-Hickam affecting military personnel and families.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2021\/12\/12\/toxic-water-consumes-daily-lives-of-many-hawaii-military-families-with-no-end-in-sight\/\" target=\"_blank\">Some families<\/a> in military housing said the water <a href=\"https:\/\/www.militarytimes.com\/pay-benefits\/2021\/12\/01\/water-worries-in-hawaii-military-housing-i-am-angry-extremely-stressed\/\" target=\"_blank\">caused ailments such as vomiting and rashes<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Red Hill storage facility houses 20 giant fuel tanks that were built near Pearl Harbor in the early 1940s. It supplies fuel to all branches of the military in Hawaii and has been the site of a series of leaks in recent years. The tanks sit 100 feet (30 meters) above an aquifer that normally supplies one-quarter of urban Honolulu\u2019s water.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Navy said officials believe <a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2021\/12\/12\/navy-blames-hawaii-water-contamination-on-jet-fuel-spill\/\" target=\"_blank\">a spill of jet fuel on Nov. 20<\/a> contaminated the tap water. The spill occurred inside an access tunnel containing fire suppression and service lines at the fuel storage facility. Officials said they don\u2019t believe a leak from the tanks themselves tainted the water.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Craig Jensen, an attorney representing the Navy, said in his closing statement Tuesday that the Navy already suspended operations until an investigation is complete.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cForever suspension is not appropriate,\u201d he said, adding that the Navy is analyzing whether it\u2019s necessary to de-fuel the tanks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He apologized to the people of Oahu for the contamination.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He said the Navy has taken steps to mitigate the problem. \u201cNo one is at actual risk of harm today, and there is no justification for any provision of this order,\u201d Jensen said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Earthjustice attorney David Henkin said this is a power struggle between the Navy and the Health Department. Henkin said his client, the Sierra Club, intervened in the case because they\u2019re concerned Hawaii won\u2019t \u201cstick to its guns\u201d in implementing the order.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Navy wants to be the one to decide on de-fueling the tanks, but if the Health Department requires it, the Navy will \u201cfight it to the death,\u201d Henkin
