Lance Gooden, R-Texas, introduced to Congress <a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/house-bill\/6869?s=1&#038;r=1\" target=\"_blank\">a bill <\/a>which, if passed, would authorize the president of the United States to issue letters of marque and reprisal to seize Russian property.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The eccentric proposal comes amid international furor over Russia\u2019s invasion of neighboring Ukraine, which began Feb. 23.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cCorrupt Russian oligarchs have enabled Putin\u2019s war,\u201d the lawmaker tweeted. \u201cThat\u2019s why I have introduced legislation to allow U.S. citizens to SEIZE yachts and jets of sanctioned Russians.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Formerly, letters of marque and reprisal allowed privately owned and operated seafaring vessels to carry out acts of war, which became known as privateering \u2014 not quite piracy, but pretty darn close.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cRussian yachts are already on the move and if the Biden Administration and our allies in Europe fail to act quickly these vessels will soon be out of our reach,\u201d Gooden said in a statement to <a href=\"https:\/\/thehill.com\/homenews\/house\/596201-lawmaker-to-offer-measure-allowing-americans-to-seize-jets-yachts-of-russia\" target=\"_blank\">The Hill<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The bill, which would allow Americans to seize property on behalf of the U.S. government, would be a return to a common practice during the War of 1812, but it has not been used since.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Letters of marque have largely been <a href=\"https:\/\/legal-dictionary.thefreedictionary.com\/Marque+and+Reprisal\" target=\"_blank\">rendered obsolete<\/a> by international treaties. However, the measure has never been removed from the U.S. Constitution. The ability to grant letters of marque is found in Article 1 of the Constitution, listed as an enumerated power of Congress.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWhile changes in warfare and developments in international law have largely vanquished their role, Congressional authority to issue such letters remains, having never been repealed,\u201d wrote Navy Cmdr. Jonathan Still in a <a href=\"https:\/\/apps.dtic.mil\/sti\/pdfs\/ADA590294.pdf\" target=\"_blank\">thesis<\/a> on the topic.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It\u2019s also unlikely that the law was<b> <\/b>meant to encompass the leisure-craft of oligarchs back in the 18th century when the Constitution was written. But such details are immaterial to Gooden, who at any moment may board Russian President Vladimir Putin\u2019s supposed 270-foot superyacht and proclaim, \u201cI am the captain
