testing positive for HIV is suing state and federal military officials.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The 20-year-old student from Revere, Massachusetts, says in a complaint filed Thursday that he tested positive for HIV in October 2020 during his sophomore year at the nation\u2019s&nbsp;<a href=\"https:\/\/www.norwich.edu\/about\/1209-norwich-university-200-year-history\">oldest private military college,<\/a>&nbsp;<a href=\"https:\/\/www.militarytimes.com\/education\/2019\/03\/22\/vermonts-norwich-university-gets-73-million-for-cyber-security-programs\/\" target=\"_blank\">Norwich University<\/a> in Northfield, Vermont.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The student, who is identified in the lawsuit only as \u201cJohn Doe,\u201d said in the complaint filed in federal court in Burlington, Vermont, that he was deemed unfit for service and dropped from the Reserve Officers\u2019 Training Corps and the <a href=\"https:\/\/www.militarytimes.com\/news\/your-army\/2022\/01\/19\/vermont-guard-soldier-saves-3-from-frozen-lake-on-christmas-day\/\" target=\"_blank\">Vermont Army National Guard<\/a> despite being healthy, asymptomatic and on a treatment regimen that renders his viral load undetectable.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The U.S. Department of Defense and the Vermont National Guard, which are among those named in the lawsuit, didn\u2019t respond to emails seeking comment Thursday.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a discharge HIV-positive troops<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">A federal judge has issued a ruling prohibiting the U.S. military from discharging HIV-positive service members or refusing to allow them to become officers.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Lawyers for Civil Rights, a Boston-based group that filed the lawsuit on the student\u2019s behalf, declined to provide copies of the student\u2019s separation notice and other discharge documents, saying they\u2019re unredacted and will be submitted under seal to the court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But the lawsuit describes in some detail the circumstances around the dismissals, including that the student was informed he would not be able to get a scholarship or contract through the ROTC program due to his HIV status and that he was no longer allowed to continue his monthly training periods with the state National Guard.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under Department of Defense regulations,&nbsp;<a href=\"https:\/\/www.esd.whs.mil\/Portals\/54\/Documents\/DD\/issuances\/dodi\/613003v1p.PDF?ver=1z_NMN3QibVdvliNabrGvA%3D%3D\">HIV is among a lengthy list of medical conditions<\/a>&nbsp;that automatically disqualify a person from enlisting, being appointed as a commissioned officer and enrollment as an ROTC scholarship cadet.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The student\u2019s lawyers argue the military\u2019s HIV policies date to the 1980s when little was known about the condition, which, if left untreated, can lead to AIDS.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cA generation after they were first developed, the military\u2019s policies are highly anachronistic and fail to reflect current medical reality,\u201d the Lawyers for Civil Rights organization argues in the lawsuit. \u201cAdvances in medical treatment and prevention have transformed HIV from a progressive, terminal disease to a manageable condition.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A federal judge in Virginia&nbsp;<a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2022\/04\/11\/judge-rules-us-military-cant-discharge-hiv-positive-troops\/\">ruled last month<\/a>&nbsp;that service members who are HIV-positive cannot be discharged or barred from becoming an officer solely because they\u2019re infected with the virus.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sophia Hall, deputy litigation director with Lawyers for Civil Rights, said the student\u2019s case is unrelated because the Virginia ruling only applied to those already in military service.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The student, in a statement provided by his lawyers, said he hopes to restore his military standing in order to follow in the footsteps of his grandfather and uncles who served in the armed forces. The lawsuit also asks the court to invalidate the military regulations and policies that led to his dismissal from the national guard and ROTC.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The
