{"id":62053,"date":"2021-04-18T16:32:47","date_gmt":"2021-04-18T16:32:47","guid":{"rendered":"https:\/\/one.sightlinemg.com\/navytimes\/uncategorized\/2021\/04\/18\/police-mistreatment-of-black-service-members-common-even-before-virginia-case\/"},"modified":"2026-08-08T11:43:51","modified_gmt":"2026-08-08T11:43:51","slug":"police-mistreatment-of-black-service-members-common-even-before-virginia-case","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2021\/04\/18\/police-mistreatment-of-black-service-members-common-even-before-virginia-case\/","title":{"rendered":"Police mistreatment of Black service members common even before Virginia case"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">NORFOLK, Va. \u2014 The police officers\u2019 guns were trained on the uniformed U.S. Army lieutenant, his arms raised and palms outstretched as he sat in his SUV under a brightly lit gas station awning. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.armytimes.com\/news\/your-army\/2021\/04\/10\/army-lieutenant-sues-police-for-pepper-spraying-threatening-him-during-stop\/\" target=_blank>Lt. Caron Nazario had been pulled over<\/a> in rural Virginia by the two officers, who repeatedly demanded that he step out of the vehicle. Nazario, who is Black and Latino, didn\u2019t move and continually asked, \u201cWhat\u2019s going on?\u201d <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI\u2019m serving this country, and this is how I\u2019m treated?\u201d he said at one point. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cYeah well, guess what? I\u2019m a veteran, too,\u201d <a href=\"https:\/\/www.armytimes.com\/news\/your-army\/2021\/04\/12\/town-fires-police-officer-involved-in-traffic-stop-of-black-army-lieutenant\/\" target=_blank>police officer Joe Gutierrez<\/a> responded. \u201cAnd I know how to obey.\u201d Nazario said he was afraid to get out, to which Gutierrez replied: \u201cYou should be.\u201d <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Within minutes, Nazario was pepper-sprayed, struck in the knees to force him to the ground and handcuffed. <a href=\"https:\/\/www.armytimes.com\/news\/your-army\/2021\/04\/13\/virginia-ag-wants-personnel-records-of-police-officers-after-army-lieutenant-stopped\/\" target=_blank>No charges were ever filed. <\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Videos of the December incident taken by the officers\u2019 body cameras and Nazario\u2019s cellphone became public last week, sparking outrage and accumulating millions of views. Nazario has sued the two officers, alleging his constitutional rights were violated during the traffic stop in the small Virginia town of Windsor. Officer Gutierrez has also been fired. <\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/armytimes\/news\/your-army\/2021\/04\/12\/town-fires-police-officer-involved-in-traffic-stop-of-black-army-lieutenant\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"169\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/AP21099708039712.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Town fires police officer involved in traffic stop of Black Army lieutenant<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">In the statement Sunday, Windsor officials said an internal investigation opened at the time into the use of force determined that department policy wasn\u2019t followed.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">The episode was a grim reminder to many Black Americans that even being in military uniform doesn\u2019t necessarily protect them from mistreatment by police. Further, there\u2019s a long history of violence against veterans and service members of color, whose military status was seen by some as a provocation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI don\u2019t think the uniform provokes in the same way that it once did, but it absolutely doesn\u2019t shield,\u201d said Bryan Stevenson, executive director of the Alabama-based Equal Justice Initiative. \u201cAnd there will be people who will be provoked by Black achievement. \u2026 It can create a kind of a desire to humiliate and demand obedience.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Thousands of Black men who served in the Civil War, World War I, and World War II were targeted because of their service and threatened, assaulted or lynched, according to a 2017 Equal Justice Initiative report. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One was <a href=\"https:\/\/www.militarytimes.com\/news\/your-navy\/2019\/11\/09\/the-blinding-of-a-wwii-vet-opened-americas-eyes-to-the-evil-of-jim-crow\/\" target=_blank>Sgt. Isaac Woodard,<\/a> a uniformed World War II veteran who was headed home on a bus in 1946. Roman Ducksworth was killed by police while riding a bus from Maryland to his home in Mississippi. The bus driver called a white police officer to awaken Ducksworth, who had fallen asleep, according to Jerry Mitchell, founder of the Mississippi Center for Investigative Reporting. The two struggled, and the officer shot and killed Ducksworth. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cHis skin color trumped his status as a military officer,\u201d Mitchell said. \u201cIt goes throughout history.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Rossano Gerald, a Black Army sergeant who sued the Oklahoma Highway Patrol after he was pulled over with his young son and subjected to a protracted search in 1998, said Nazario\u2019s traffic stop shows that nothing has changed. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe have to keep reminding people that this is not gone,\u201d said Gerald, who won a a $75,000 legal settlement three years after the incident. \u201cWe\u2019ve got to fight for our rights.\u201d <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In his own case, Gerald said he believes his active-duty military status only fueled the trooper\u2019s desire to show his power. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cFrom my perspective, he wanted to prove a point that he was in control,\u201d Gerald, a decorated veteran, said in an interview. <\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"2000\" height=\"1409\" src=\"\/wp-content\/uploads\/2026\/08\/AP21106706620912.jpg.jpg\" alt=\"\" class=\"wp-image-98575\" srcset=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/AP21106706620912.jpg.jpg 2000w, https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/AP21106706620912.jpg.jpg?resize=300,211 300w, https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/AP21106706620912.jpg.jpg?resize=768,541 768w, https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/AP21106706620912.jpg.jpg?resize=1024,721 1024w, https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/AP21106706620912.jpg.jpg?resize=1536,1082 1536w\" sizes=\"auto, (max-width: 2000px) 100vw, 2000px\" \/><figcaption class=\"wp-element-caption\">In this March 30, 2000, photo, Sgt. (C-SPAN via AP)<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Gerald, who was not wearing his uniform, handed over his military ID along with his driver\u2019s license and told the trooper to call his commanding officer, per military protocol. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Instead, Gerald and his son were placed in a hot patrol car while troopers repeatedly searched his car. At one point, a trooper asked the 12-year-old if he had any weapons and conducted a pat search of the child, the lawsuit claimed. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The search turned up no evidence of drugs, and Gerald was given a warning ticket for failure to signal a lane change. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Since the videos of Nazario\u2019s traffic stop became public, Virginia Gov. Ralph Northam has called for an investigation by state police. And state Attorney General Mark Herring has <a href=\"https:\/\/www.armytimes.com\/news\/your-army\/2021\/04\/13\/virginia-ag-wants-personnel-records-of-police-officers-after-army-lieutenant-stopped\/\" target=_blank>requested the two officers\u2019 personnel records <\/a>and use-of-force records from the department, among other documents.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cEven if Nazario drapes his body in the highest symbolic capital, that being United States military attire, it doesn\u2019t gain him anything,\u201d said K. Nyerere Tur\u00e8, an assistant professor of criminal justice at Quinnipiac University. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tur\u00e8, a former police officer, said he was once pulled over by police in Georgia while wearing his full uniform in his personal vehicle. He got cited for driving 5 mph over the speed limit. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAnd I understood this is not about policing,\u201d Tur\u00e8 said. \u201cRace itself in America trumps our professional titles, our honorifics.\u201d<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/airforcetimes\/news\/your-air-force\/2020\/12\/21\/consistent-widespread-racial-disparities-hurt-black-airmen-ig-study-finds\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/AIR-courage-3.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Consistent, widespread racial disparities hurt Black airmen, IG study finds<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The review drew an overwhelming response from airmen telling the stories of their experiences with race in the Air Force.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Richard Brookshire, co-founder and executive director of the Black Veterans Project, said it\u2019s important to remember that racism exists not only in the civilian world but also the military.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In February, Lloyd Austin, <a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2021\/01\/24\/for-1st-black-pentagon-chief-racism-challenge-is-personal\/\" target=_blank>the nation\u2019s first Black defense secretary<\/a>, ordered military leaders to talk to troops about extremism in the ranks, after a number of former and current military members took part in the Jan. 6 U.S. Capitol riot. And last year, the Air Force released a report concluding <a href=\"https:\/\/www.airforcetimes.com\/news\/your-air-force\/2020\/12\/21\/consistent-widespread-racial-disparities-hurt-black-airmen-ig-study-finds\/\" target=_blank>the branch\u2019s Black members <\/a>are far more likely to be investigated, arrested, face disciplinary actions and be discharged for misconduct. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe same kind of racial bias in policing that shows up in our communities exists within the military,\u201d Brookshire said. \u201cThat is just as important a conversation as whether they\u2019re harassed by a civilian cop when they leave the base.\u201d <\/p>\n","protected":false},"excerpt":{"rendered":"<p>The traffic stop of Lt.
