{"id":64739,"date":"2019-01-29T21:27:15","date_gmt":"2019-01-29T21:27:15","guid":{"rendered":"https:\/\/one.sightlinemg.com\/navytimes\/uncategorized\/2019\/01\/29\/court-rules-va-must-pay-disability-benefits-to-blue-water-vietnam-veterans\/"},"modified":"2026-08-08T12:19:05","modified_gmt":"2026-08-08T12:19:05","slug":"court-rules-va-must-pay-disability-benefits-to-blue-water-vietnam-veterans","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/navytimes\/veterans\/2019\/01\/29\/court-rules-va-must-pay-disability-benefits-to-blue-water-vietnam-veterans\/","title":{"rendered":"Court rules VA must pay disability benefits to \u2018blue water\u2019 Vietnam veterans"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">WASHINGTON \u2014 A federal court ruled Tuesday that the Department of Veterans Affairs cannot deny disability benefits to <a href=\"https:\/\/www.militarytimes.com\/veterans\/2018\/05\/04\/new-blue-water-veterans-deal-could-mean-benefits-for-90000-vietnam-war-troops\/\" target=_blank>thousands of Vietnam veterans<\/a> who claim exposure to cancer-causing chemical defoliants simply because those vets served in the waters off the country\u2019s coastline, and not inland.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ruling marks a major victory for so-called <a href=\"https:\/\/www.militarytimes.com\/veterans\/2017\/09\/02\/advocates-hope-to-restart-debate-over-benefits-for-blue-water-navy-vets\/\" target=_blank>\u201cblue water\u201d Navy veterans<\/a> who have fought the department for years over the denials. VA officials have said the existing scientific evidence <a href=\"https:\/\/www.militarytimes.com\/veterans\/2018\/09\/20\/former-va-secretaries-spar-over-blue-water-navy-benefits\/\" target=_blank>doesn\u2019t justify the presumption<\/a> of toxic exposure for the group and have strongly opposed legislative efforts to overturn their decision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But <a href=\"http:\/\/www.cafc.uscourts.gov\/sites\/default\/files\/opinions-orders\/17-1821.Opinion.1-29-2019.pdf\" target=_blank>the 9-2 decision<\/a> by the U.S. Court of Appeals for the Federal Circuit overturns past court opinions backing up VA, saying that Congress never intended to exclude servicemembers in the seas around Vietnam when they awarded presumptive benefits for certain illnesses related to Agent Orange exposure.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/news\/pentagon-congress\/2019\/01\/08\/lawmakers-hope-for-swift-action-this-year-on-blue-water-vietnam-veterans-benefits\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/AP_660911090.jpg_7d1766.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Lawmakers hope for swift action this year on \u2018blue water\u2019 Vietnam veterans benefits<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Both leaders of the House Veterans&#039; Affairs Committee are trying to revive the legislative effort that stalled last month.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Under current department rules, the blue water veterans can receive medical care for their illnesses through VA. But to receive disability benefits \u2014 worth up to several thousand dollars a month \u2014 they must prove that their ailments are directly connected to toxic exposure while on duty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That\u2019s not the case for other Vietnam veterans, who are presumed to have been exposed to Agent Orange and other defoliants known to cause serious and rare cancers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">So while a veteran who served on the shoreline could receive disability payouts after contracting Parkinson\u2019s Disease or prostate cancer, another vet who served on a ship a few miles away would have to provide evidence of direct contact with hazardous chemicals.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Advocates have said that, given the time that has passed since the war, obtaining such proof is impossible and unfair. In their ruling, the federal judges agreed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThese statutes cast no doubt on our conclusion that, by using the formal term \u2018Republic of Vietnam,\u2019 Congress unambiguously referred, consistent with uniform international law, to both its landmass and its 12-nautical-mile territorial sea,\u201d the ruling states.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If VA officials opt not to appeal the decision to the Supreme Court in the next 90 days \u2014 or if the court decides not to hear the case \u2014 the result means that up to 90,000 blue water veterans could see disability payouts as early as this year.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a statement, VA spokesman Curt Cashour said the department is reviewing this decision and \u201cwill determine an appropriate response.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Advocates hailed the news as a major step ahead in their effort to win benefits for the aging veterans.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis is a big win,\u201d said John Wells, retired Navy commander and the executive director of Military-Veterans Advocacy, which helped file the lawsuit. \u201cWe want to work with VA on how to implement this as painlessly as possible, but making sure these veterans get all they deserve.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bart Stichman, executive director of the National Veterans Legal Services Program, said the decision \u201cunequivocally rights a wrong that is a terrible injustice to all veterans who were exposed to Agent Orange in the waters of Vietnam.\u201d<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/news\/2018\/11\/19\/new-research-could-lead-to-disability-benefits-for-vietnam-veterans-with-high-blood-pressure\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"195\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/Vietnam.jpg_0fe378.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">New research could lead to disability benefits for Vietnam veterans with high blood pressure<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Researchers are upgrading the link between Agent Orange exposure and hypertension.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Legislation that would have awarded presumptive status to the blue water veterans was blocked by a small group of senators at the end of last year, disappointing advocates who saw the legislative momentum as their best chance for a victory in years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Now, instead of granting the benefits to veterans, lawmakers may be forced to scramble new bills to cover the cost of the court-ordered awards.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Congressional Budget Office officials had estimated that awarding the benefits to the blue water veterans could total about $1.1 billion over 10 years, but VA officials have insisted the total is closer to $5.5 billion. Disagreements over whether to use new home loan fees to pay for the costs stalled the previous legislation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the court order stands, VA will be forced to cover the costs regardless of whether an offset is agreed upon, a potential drain on the department\u2019s annual budget. Several new bills on the issue are already pending before Congress, and the chairmen of both the House and Senate Veterans\u2019 Affairs Committees have promised to deal with the topic quickly this year. In a statement, Senate chairman Johnny Isakson, R-Ga., said that he was pleased with the court decision and would work closely with VA on the next steps.<\/p>\n\n\n\n<p
