{"id":71092,"date":"2022-02-09T20:34:57","date_gmt":"2022-02-09T20:34:57","guid":{"rendered":"https:\/\/one.sightlinemg.com\/navytimes\/uncategorized\/2022\/02\/09\/ftc-bites-burger-chain-for-making-false-promises-to-vets-others\/"},"modified":"2026-08-08T15:00:59","modified_gmt":"2026-08-08T15:00:59","slug":"ftc-bites-burger-chain-for-making-false-promises-to-vets-others","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/navytimes\/veterans\/2022\/02\/09\/ftc-bites-burger-chain-for-making-false-promises-to-vets-others\/","title":{"rendered":"FTC bites burger chain for making false promises to vets, others"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Fast-food chain Burgerim \u201cpocketed tens of millions of dollars\u201d in franchise fees from <a href=\"https:\/\/www.militarytimes.com\/veterans\/2021\/12\/08\/four-sentenced-in-fraudulent-va-construction-scheme\/\" target=\"_blank\">veterans<\/a> and others by making <a href=\"https:\/\/www.militarytimes.com\/news\/2022\/01\/25\/she-helped-15-million-tricare-fraud-scheme-to-push-unneeded-drugs-on-vets\/\" target=\"_blank\">false <\/a>promises and withholding information, <a href=\"https:\/\/www.ftc.gov\/system\/files\/documents\/cases\/2022.02.07_complaint_filed_002_0.pdf\" target=\"_blank\">according<\/a> to a civil complaint filed by the Federal Trade Commission.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The complaint, filed Monday, Feb. 7 in the U.S. District Court of Central California, alleges that California-based Burgerim charged upwards of $70,000 fees to prospective franchisees with assurances that if a franchisee could not open a restaurant, Burgerim would refund the fee. However, the \u201coverwhelming majority\u201d of the 1,500 consumers who purchased a franchise were never able to open a store, and \u201cmany\u201d of them never received their refund.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The FTC alleges that Bugerim misrepresented \u201cmaterial facts\u201d which constitute \u201cdeceptive acts\u201d that are prohibited by Section 5(a) of the FTC Act, as well as \u201cThe Franchise Rule.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Burgerim faces one count of violating Section 5 of the FTC Act. Additionally, Burgerim is charged with three counts of violating \u201cThe Franchise Rule.\u201d These counts include multiple disclosure violations, among them allegations that Burgerim deliberately misrepresented financial information, such as the actual cost franchisees would incur and how well Burgerim franchises perform in reality.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Plaintiff\u2019s request that the court award \u201cmonetary and other equitable relief\u201d for each person impacted by Burgerim\u2019s violation of the Franchise Rule. According to the FTC, each offense carries a financial penalty of up to $46,517.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under the Franchise Rule, Burgerim is responsible for providing prospective franchisees a financial disclosure to have a clear picture of their total financial commitment, including potential operating costs once a location is open. The suit alleges that Burgerim not only withheld this information but deliberately misrepresented both the costs and the challenges associated with opening a location.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cBurgerim promised consumers, including veterans, the American dream, only to leave them in a nightmare of debt and deceit,\u201d Samuel Levine, Director of the FTC\u2019s Bureau of Consumer Protection, <a href=\"https:\/\/www.ftc.gov\/news-events\/press-releases\/2022\/02\/ftc-sues-burger-franchise-company-targets-veterans-others-false?utm_source=govdelivery\" target=\"_blank\">said <\/a>in a press release.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Burgerim officials did not immediately respond to a request for comment on the pending litigation at the time of publication.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the complaint, Burgerim lured \u201cwould-be entrepreneurs\u201d into investing by touting their franchise as a \u201cbusiness in a box,\u201d stating that would-be franchisees did not need any prior business experience.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To further assuage concerns about the significant up-front investment required by potential franchisees, Burgerim would speak as if the opportunity was a potential cash cow. One representative from Burgerim told a franchisee that the \u201cbreak-even point\u201d was $50,000 in profit per month, a number that the representative from Burgerim said open stores were \u201call hitting\u201d in \u201ctwo weeks or sooner.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAll you need is the will to succeed,\u201d Burgerim\u2019s <a href=\"https:\/\/burgerim.com\/\" target=\"_blank\">website<\/a> reads. \u201cOur international fast food franchising team paves the way for you to become a thriving business owner. We\u2019ll help you customize your location, hire a small team, and generate wealth.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The initial investment, according to the complaint, was hefty. These fees range from $50,000 to $70,000, with discounts given to those who purchased more than one franchise. Burgerim further enticed veterans through discounts of $10,000 and $15,000 on their initial fees.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A spokesperson for the FTC could not tell Military Times how many veterans were targeted or are currently part of the suit. However, the complaint states that Burgerim \u201cincentivized veterans to purchase more than one location by offering a discount to veterans who purchased multiple locations.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to the complaint, these fees only provided investors with the right to open a franchise with the Burgerim name. The initial fee did not include other costs associated with opening a franchise, such as securing a location, building the restaurant, equipment, or supplies for running the franchise. The suit states that the actual cost for opening a restaurant cost at least one franchisee upwards of $600,000.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To further downplay the financial risks of franchisees, many of whom took loans from the Small Business Administration, Burgerim promised franchisees both verbally and in writing that the franchisees would have their franchise fees refunded should their location not open.
