{"id":71873,"date":"2022-12-29T23:36:03","date_gmt":"2022-12-29T23:36:03","guid":{"rendered":"https:\/\/one.sightlinemg.com\/navytimes\/uncategorized\/2022\/12\/29\/new-in-2023-pact-act-processing-set-to-start-jan-1\/"},"modified":"2026-08-08T15:14:07","modified_gmt":"2026-08-08T15:14:07","slug":"new-in-2023-pact-act-processing-set-to-start-jan-1","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/navytimes\/veterans\/2022\/12\/29\/new-in-2023-pact-act-processing-set-to-start-jan-1\/","title":{"rendered":"New in 2023: PACT Act processing set to start Jan. 1"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Last summer, Congress passed <a href=\"https:\/\/www.militarytimes.com\/veterans\/2022\/12\/09\/va-plans-week-of-action-to-highlight-new-toxic-exposure-benefits\/\" target=\"_blank\">landmark veterans benefits legislation <\/a>that could provide new health care options and disability payouts to as many as one in every five living American veterans.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Now, the <a href=\"https:\/\/www.militarytimes.com\/veterans\/2022\/12\/12\/va-starting-work-on-terminally-ill-vets-pact-act-claims-immediately\/\" target=\"_blank\">Department of Veterans Affairs <\/a>has to deliver on that promise.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Jan. 1 marks the first day <a href=\"https:\/\/www.militarytimes.com\/veterans\/2022\/12\/06\/va-urges-veterans-to-get-covid-boosters-before-holiday-season\/\" target=\"_blank\">VA officials<\/a> can officially begin processing all claims related to the Promise to Address Comprehensive Toxics Act \u2014 better known as the PACT Act. Since the end of last summer, more than 176,000 veterans have submitted paperwork related to military toxic exposure issues covered in the measure.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/veterans\/2022\/12\/12\/va-starting-work-on-terminally-ill-vets-pact-act-claims-immediately\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"198\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/AP22088675831055-1.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">VA starting work on terminally ill vets\u2019 PACT Act claims immediately<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The move could speed up benefits for about 2,500 veterans.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">In early December, VA Secretary Denis McDonough said that officials have been preparing for the increased workload for months, developing processes and procedures to make sure that all of the claims are handled as quickly as possible.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But he also urged patience on the part of veterans looking for long-awaited compensation for their injuries.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cUntil we get into each case, we won\u2019t know how quickly we can resolve them,\u201d he said. \u201cSome cases will be resolved in days, some in weeks, some in months.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The legislation provides for presumptive benefit status for 12 types of cancer and 12 other respiratory illnesses<a href=\"https:\/\/www.militarytimes.com\/news\/burn-pits\/2022\/03\/29\/what-are-military-burn-pits-and-why-are-veterans-worried-about-them\/\" target=\"_blank\"> linked to burn pit exposure <\/a>in the Gulf War, the War in Afghanistan and the War in Iraq.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Advocates have fought for years for better coverage of those illnesses, saying that inflexible VA rules blocked tens of thousands of suffering veterans from getting the care and compensation they deserve.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The new law also provides presumptive benefit status for hypertension and monoclonal gammopathy of undetermined significance (MGUS) among veterans who served in Vietnam and radiation-related illnesses for veterans who served in several new locations in the 1960s and early 1970s.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">VA officials spent much of the past two months urging veterans to sign up for the new benefits. Nearly 700,000 have undergone toxic exposure screening at VA medical centers since mid-November, a process that includes information on care and the payouts for which individuals may qualify.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And staffers earlier this month began processing a small number of PACT Act claims involving terminally ill veterans to ensure they get their benefits as soon as possible. That work served as early practice for the flood of claims about to hit the system on Jan. 1.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/veterans\/2022\/12\/09\/va-plans-week-of-action-to-highlight-new-toxic-exposure-benefits\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"225\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/IMG_5312.JPG.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">VA plans \u2018week of action\u2019 to highlight new toxic exposure benefits<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The move builds on months of efforts to publicize health care and disability payouts available through the PACT Act.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">In 2012, Congress dramatically expanded benefits for illnesses related to Agent Orange exposure in Vietnam. The resulting workload caused the backlog of disability claims to balloon in following months, peaking at more than 611,000 cases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">VA officials have warned with this expansion, the backlog (cases pending for more than 120 days) is likely to rise again, although they hope to be nowhere near the same levels.<\/p>\n\n\n\n<p
