{"id":73813,"date":"2022-09-02T14:30:10","date_gmt":"2022-09-02T14:30:10","guid":{"rendered":"https:\/\/one.sightlinemg.com\/navytimes\/uncategorized\/2022\/09\/02\/va-to-provide-abortions-in-cases-of-rape-danger-to-womans-life\/"},"modified":"2026-08-18T20:57:52","modified_gmt":"2026-08-18T20:57:52","slug":"va-to-provide-abortions-in-cases-of-rape-danger-to-womans-life","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/navytimes\/veterans\/2022\/09\/02\/va-to-provide-abortions-in-cases-of-rape-danger-to-womans-life\/","title":{"rendered":"VA to provide abortions in cases of rape, danger to veteran\u2019s health"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/www.militarytimes.com\/news\/burn-pits\/2022\/09\/01\/vets-can-apply-for-all-pact-act-benefits-now-after-va-speeds-up-law\/\" target=\"_blank\">Department of Veterans Affairs<\/a> plans to offer <a href=\"https:\/\/www.militarytimes.com\/veterans\/2022\/08\/01\/va-secretary-sidesteps-calls-for-department-to-provide-abortion-services-at-its-medical-centers\/\" target=\"_blank\">abortion access<\/a> to veterans and eligible dependents in cases of rape, incest and pregnancies that endanger the life or health of an individual, arguing the change is needed after more than two dozen states<a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2022\/07\/05\/pentagon-ends-blocking-of-abortion-related-sites-on-computer-networks\/\" target=\"_blank\"> banned the procedure this summer<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The move marks the first time VA physicians could perform abortions on federal property, even in states where it has been outlawed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The decision comes 10 weeks after the <a href=\"https:\/\/www.militarytimes.com\/news\/pentagon-congress\/2022\/07\/29\/service-members-military-doctors-detail-obstacles-to-abortion-access-after-supreme-court-ruling\/\" target=\"_blank\">Supreme Court overturned<\/a> its 1973 Roe vs. Wade ruling, which legalized abortion nationwide. That in turn has prompted a national debate over the department\u2019s responsibilities and limits in regards to reproductive health services for women veterans.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Administration officials have argued that VA employees, when working within the scope of their federal jobs, may provide needed services regardless of state restrictions.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/news\/your-military\/2022\/07\/29\/service-members-military-doctors-detail-obstacles-to-abortion-access-after-supreme-court-ruling\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Service members, military doctors detail obstacles to abortion access after Supreme Court ruling<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The end of Roe v. Wade made abortion even more difficult to access for troops and their families.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Under a proposed rule submitted to the Federal Register Thursday night, VA health care providers could also coordinate abortions with private sector medical offices in locations where the procedures are allowed, and provide counseling on options to all pregnant veterans and eligible beneficiaries.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Both the counseling and abortion procedures would be authorized as soon as next week, pending publication by federal officials and potential legal challenges.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a statement, VA Secretary Denis McDonough called the move \u201ca patient safety decision\u201d that will fill a critical gap in available medical care.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cPregnant veterans and VA beneficiaries deserve to have access to world-class reproductive care when they need it most,\u201d he said. \u201cThat\u2019s what our nation owes them, and that\u2019s what we at VA will deliver.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">VA officials do not know how many veterans may qualify for abortion procedures.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">About 2 million women veterans live in America today. In addition, dependents who are enrolled in VA\u2019s Civilian Health And Medical Program (CHAMPVA) would also be eligible for certain abortion services. That program covered about 434,000 individuals last year.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Since the Supreme Court decision in late June, at least 25 states have started to place limits or already imposed restrictions on health care workers from providing abortions. Some of those moves have been blocked by legal challenges.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Texas, Florida, Kentucky, Louisiana and Ohio currently have near total bans on the procedure. VA appears to be using that legal defense to justify the changes.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a statement on Friday, House Veterans\u2019 Affairs Committee ranking member Mike Bost, R-Ill., attacked VA\u2019s announcement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAbortion is wrong, and Congress prohibited VA from providing it decades ago,\u201d he said. \u201cThis proposal is contrary to longstanding, settled law and a complete administrative overreach. I oppose it and am already working to put a stop to it.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">VA officials noted that veterans face a higher risk of experiencing pregnancy-related complications due to increased rates of chronic health conditions, making access to abortion necessary \u201cto protect the life and health of pregnant veterans.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Determination of whether a veteran\u2019s life or health is at risk from pregnancy will be made on a case-by-case basis after consultation with VA health care providers. Officials said that self-reporting from a veteran or VA beneficiary \u201cwill constitute sufficient evidence that an act of rape or incest occurred.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Exactly when and where procedures may take place is unclear. Department officials said that after the rule is published, which is expected in the next few days, they will immediately prepare to provide services in \u201cas many locations as possible.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">More information on the available services is available on <a href=\"https:\/\/www.womenshealth.va.gov\/WOMENSHEALTH\/topics\/abortion-services.asp\" target=\"_blank\">VA\u2019s website<\/a>.
