The judge is expected to hear more arguments Friday on <a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2023\/04\/27\/releasing-leak-suspect-a-national-security-risk-feds-say\/\" target=\"_blank\">prosecutors\u2019 detention request<\/a> and issue a ruling.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/news\/pentagon-congress\/2023\/04\/19\/air-national-guardsman-age-not-key-in-pentagon-leaks-austin-says\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/7748697.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Air National Guardsman age not key in Pentagon leaks, Austin says<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Defense Secretary Lloyd Austin said Wednesday in Sweden that the \u201cvast majority\u201d of the U.S. military is young.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Teixeira is accused of sharing highly classified documents about top national security issues in a chatroom on Discord, a social media platform that started as a hangout for gamers. He has not yet entered a plea.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prosecutors told the judge in their filing that Teixeira continued leaking documents even after he was admonished by superiors on two separate occasions last year over \u201cconcerning actions\u201d he took related to classified information.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mad.255930\/gov.uscourts.mad.255930.34.2_1.pdf\" target=\"_blank\">A September memo<\/a> from the Air National Guard 102nd Intelligence Wing that prosecutors filed in court says Teixeira had been observed taking notes on classified intelligence information and putting the notes in his pocket. Teixeira was instructed at the time to no longer take notes in any form on classified intelligence information, the memo says.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Another <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mad.255930\/gov.uscourts.mad.255930.34.3_1.pdf\" target=\"_blank\">memo from late October<\/a> says a superior had been made aware that Teixeira was \u201cpotentially ignoring the cease-and-desist order on deep diving into intelligence information\u201d given to him the month before. The memo says Teixeira attended a meeting and proceeded to ask \u201cvery specific questions.\u201d He was told again to focus on his job, not any \u201cdeep dives\u201d into classified intelligence information.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Still, a third <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.mad.255930\/gov.uscourts.mad.255930.34.4_1.pdf\" target=\"_blank\">memo from February<\/a> says Teixeira was again observed viewing information \u201cthat was not related to his primary duty and was related to the intelligence field.\u201d Teixeira \u201chad previously been notified to focus on his own career duties and to not seek out intelligence products,\u201d the memo said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe Defendant even continued to share information with his online associates, defying these admonishments and taking further efforts to conceal his unlawful conduct,\u201d prosecutors wrote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Lawyers for Teixeira, who was arrested last month on charges under the Espionage Act, are urging the judge to release Teixeira to his father\u2019s home, noting that the man didn\u2019t flee when media outlets began publishing his name shortly before his April 13 arrest. His lawyer told the judge last month that Teixeira \u201cwill answer the charges\u201d and \u201cwill be judged by his fellow citizens.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In their own court filing Wednesday, Teixeira\u2019s lawyers noted there have been many Espionage Act cases in which courts have approved release or the government did not seek to keep the person behind bars pretrial. They have also said there is no allegation that Teixeira ever intended for documents to be distributed widely.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But prosecutors said in their filing Wednesday that one of the servers on the social media platform he posted classified information to had at least 150 users at the time the information was shared and \u201cnow may have many more users that are actively seeking access to information.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAmong the individuals with whom the Defendant shared government information are a number of individuals who represented that they resided in other countries and who logged on to the social media platform using foreign IP addresses,\u201d prosecutors wrote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In messages, Teixeira bragged about the scope of information he had access to, writing, \u201cThe information I give here is less than half of what\u2019s available,\u201d prosecutors said. He also acknowledged he wasn\u2019t supposed to be sharing the information, prosecutors said, writing in another message, \u201cAll of the s\u2014- I\u2019ve told you guys I\u2019m not supposed to,\u201d according to the Justice Department\u2019s filing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Magistrate Judge David Hennessy heard arguments from lawyers over detention late last month, but has yet to issue a ruling and scheduled a second hearing on the matter for Friday. In earlier court records, prosecutors revealed that Teixeira kept an arsenal of weapons before his arrest and has a history of violent and disturbing remarks.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The leaked documents appear to detail U.S. and NATO aid to Ukraine and U.S. intelligence assessments regarding U.S. allies that could strain ties with those nations. Some show real-time details from February and March of Ukraine\u2019s and Russia\u2019s battlefield positions and precise numbers of battlefield gear lost and newly flowing into Ukraine from its
