{"id":74588,"date":"2023-06-30T17:15:00","date_gmt":"2023-06-30T17:15:00","guid":{"rendered":"https:\/\/one.sightlinemg.com\/navytimes\/uncategorized\/2023\/06\/30\/lawmakers-eye-ending-affirmative-action-at-military-academies\/"},"modified":"2026-08-08T15:39:12","modified_gmt":"2026-08-08T15:39:12","slug":"lawmakers-eye-ending-affirmative-action-at-military-academies","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/navytimes\/news\/pentagon-congress\/2023\/06\/30\/lawmakers-eye-ending-affirmative-action-at-military-academies\/","title":{"rendered":"Lawmakers eye ending affirmative action at military academies"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Thursday\u2019s<a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2022\/10\/26\/if-supreme-court-ends-affirmative-action-how-will-the-military-adapt\/\" target=\"_blank\"> Supreme Court decision<\/a> which ended the use of affirmative action in college admissions <a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2023\/06\/29\/service-academies-exempt-from-supreme-court-affirmative-action-ruling\/\" target=\"_blank\">contained a carve out for military service academies<\/a>, but a key Senate Republican wants to eliminate it there too.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Shortly after the ruling was announced, Senate Armed Services Committee ranking member <a href=\"https:\/\/twitter.com\/SenatorWicker\/status\/1674495372578680836?s=20\" target=\"_blank\">Roger Wicker, R-Miss., took to social media<\/a> to praise the court\u2019s ruling and his aim to \u201cfurther prohibit our military service academies from engaging in race-based affirmative action.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Earlier in June, Wicker introduced his Military Merit, Fairness, and Equality Act, which would \u201cprohibit the Department of Defense from prioritizing the demographic characteristics of service members above individual merit and demonstrated performance.\u201d Although the military academies are not specifically mentioned in the legislation, it would cover all defense-affiliated institutions.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In connection with the <a href=\"https:\/\/www.supremecourt.gov\/opinions\/22pdf\/20-1199_hgdj.pdf\" target=\"_blank\">high court\u2019s 6-3 ruling on affirmative action<\/a> this week, Chief Justice John Roberts wrote that none of the military academies were part of the case before the justices, and therefore the decision does not address how race-based admission systems may impact \u201cthe potentially distinct interests that military academies may present.\u201d<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/news\/your-military\/2023\/06\/29\/service-academies-exempt-from-supreme-court-affirmative-action-ruling\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/AP23145541254003.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Service academies exempt from Supreme Court affirmative action ruling<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">&quot;The potentially distinct interests&quot; of service academies was a reason Chief Justice John Roberts cited as to not yet address their admissions practices.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Wicker, who plans to offer his legislation as an amendment to the annual defense authorization bill during floor debate in July, said the move is needed to bring \u201cfairness\u201d back to the armed forces and refocus military leaders on lethality, readiness and other relevant force priorities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On Friday, Rep. Tom Tiffany, R-Wisc., <a href=\"https:\/\/amendments-rules.house.gov\/amendments\/TIFFAN_021_xml230627113021090.pdf\" target=\"_blank\">introduced similar language<\/a> as an amendment to the House draft of the annual authorization bill, banning the Defense Department from \u201cgranting preferential treatment to any person or group based in whole or in part on race.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Senate Democratic leaders have already pushed back against those proposals, calling them political interference in the military\u2019s efforts to ensure that the fighting force represents the demographics of the country at large.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Numerous Democrats also sharply criticized the Supreme Court\u2019s Thursday ruling, and called the exception for military academies perplexing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cSo military academies can use race-conscious admissions policies because it\u2019s fine to explicitly and intentionally send our Black and brown kids off to die, but not explicitly and intentionally give them access to education?\u201d<a href=\"https:\/\/twitter.com\/RepBowman\/status\/1674533952311402496?s=20\" target=\"_blank\"> Rep. Jamaal Bowman, D-N.Y., <\/a>wrote in a social media post following the Supreme Court ruling.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">And adding insult to injury is that the Court exempted military service academies, like West Point and the Naval Academy, from its own ruling.  <br><br>So the majority on the Court does in fact recognize the inherent importance of a diverse military and that diversity makes our country\u2026<\/p>&mdash; Elissa Slotkin (@ElissaSlotkin) <a href=\"https:\/\/x.com\/ElissaSlotkin\/status\/1674536107336237056?ref_src=twsrc%5Etfw\">June 29, 2023<\/a><\/blockquote><script async src=\"https:\/\/platform.x.com\/widgets.js\" charset=\"utf-8\"><\/script>\n<\/div><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/twitter.com\/RepJasonCrow\/status\/1674443284783964160\" target=\"_blank\">Rep. Jason Crow, D-Colo.<\/a> and an Army veteran, echoed that sentiment, calling the decision \u201coutright grotesque\u201d because of the military carve out.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Last year, as part of the case pending before the Supreme Court, <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/20\/20-1199\/232531\/20220801183329801_20-1199%20and%2021-707_Brief%20of%20Amici%20Curiae%20Former%20Military%20Leaders.pdf\" target=\"_blank\">35 former top military leaders filed a friend-of-the-court brief arguing that affirmative action was necessary<\/a> for national security, both in the academies and for Reserve Officer Training Corps students at private universities.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Republican measures face a difficult legislative path ahead. Wicker\u2019s language is unlikely to advance in the Democratic-controlled Senate. Tiffany\u2019s measure could see more success in the Republican-controlled House, but would still have to survive negotiations with Senate leaders before becoming law.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Both chambers are expected to resume debate on the authorization bills \u2014 which include hundreds of policy changes and budget priorities for the military \u2014 when
