{"id":75375,"date":"2023-09-20T17:40:08","date_gmt":"2023-09-20T17:40:08","guid":{"rendered":"https:\/\/one.sightlinemg.com\/navytimes\/uncategorized\/2023\/09\/20\/pentagon-to-revisit-dont-ask-dont-tell-discharges\/"},"modified":"2026-08-08T15:25:37","modified_gmt":"2026-08-08T15:25:37","slug":"pentagon-to-revisit-dont-ask-dont-tell-discharges","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2023\/09\/20\/pentagon-to-revisit-dont-ask-dont-tell-discharges\/","title":{"rendered":"Pentagon to revisit \u2018Don\u2019t Ask, Don\u2019t Tell\u2019 discharges"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><i>Editor\u2019s note: This story has been updated with comment from LGBTQ+ veterans at 630pm EDT.<\/i><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Pentagon unveiled new efforts Wednesday to reevaluate discharges of thousands of LGBTQ+ veterans who were forced out of service because of their sexuality under the military\u2019s \u201cDon\u2019t Ask, Don\u2019t Tell\u201d policy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Department officials will soon begin a \u201cproactive review\u201d of LGBTQ+ veterans who were handed less than honorable discharges because of their sexual preference, and possibly look to upgrade their discharge status.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The initiative arrives on the 12-year anniversary of the repeal of \u201cDon\u2019t Ask, Don\u2019t Tell.\u201d The policy, enacted in 1994, prohibited LGBTQ+ service members from disclosing or openly embracing their sexual orientation while in uniform.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Pentagon estimates that thousands of LGBTQ+ troops <a href=\"https:\/\/www.defense.gov\/Spotlights\/Dont-Ask-Dont-Tell-Resources\/\" target=\"_blank\">received<\/a> less than honorable discharges for \u201chomosexual conduct\u201d during the policy\u2019s lifetime. Advocates believe that at least 35,000 service members were released from duty because of their sexual orientation between 1980 and 2011.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A less than honorable discharge can spell poor job prospects after military service and limit access to a range of veterans benefits, including loans, healthcare, and funerary expenses.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A group of veterans impacted by \u201cDon\u2019t Ask, Don\u2019t Tell\u201d sued the Defense Department in early August to upgrade their discharges and strike any mention of their sexuality from their military records \u2014 designations they claim violate their privacy. One of the plaintiffs for, Marine Corps veteran Julianne \u2018Jules\u2019 Sohn, was one of thousands to be involuntarily discharged under the DADT policy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cOver 29,000 of those veterans did not receive an honorable discharge and should have their discharges upgraded,\u201d<a href=\"https:\/\/www.militarytimes.com\/opinion\/2023\/09\/07\/justice-is-long-overdue-for-lgbtq-veterans\/\" target=\"_blank\"> Sohn wrote in Military Times <\/a>of why they are bringing the case. \u201cFewer than 1,500 eligible veterans have been able to upgrade their discharges.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While Sohn\u2019s group, \u201c<a href=\"http:\/\/www.justiceforlgbtqveterans.com\/\" target=\"_blank\">Justice for LGBTQ+ Veterans<\/a>\u201d welcomed Wednesday\u2019s announcement, they declined to say if they\u2019d drop their <a href=\"https:\/\/static1.squarespace.com\/static\/64c94be754e1a62dc1a0d8c9\/t\/64d2e4c25ca281066283ffde\/1691542722745\/LGBTQ+Vets+-+Complaint.pdf\" target=\"_blank\">complaint<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWhile we appreciate DOD\u2019s statement, much work lies ahead,\u201d they wrote in a statement to Military Times. \u201cUntil every veteran discharged under \u2018Don\u2019t Ask Don\u2019t Tell\u2019 and its predecessor policies receives the long-delayed justice they deserve, we remain committed to advocating for the rights and dignity of LGBTQ veterans who have been affected by this historical injustice.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Veterans can <a href=\"https:\/\/www.defense.gov\/Spotlights\/Dont-Ask-Dont-Tell-Resources\/\" target=\"_blank\">apply<\/a> to have their discharge status reviewed, but Sohn\u2019s attorneys have described the process as \u201cburdensome, opaque, expensive, and, for many veterans, virtually inaccessible.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pentagon leaders hope the new review process will cut some of that red tape.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cOver the past decade, we\u2019ve tried to make it easier for service members discharged based on their sexual orientation to obtain corrective relief,\u201d Secretary of Defense Lloyd Austin said in a statement. \u201cWhile this process can be difficult to navigate, we are working to make it more accessible and efficient.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">U.S. defense officials speaking at a press conference Wednesday morning did not specify when the \u201cproactive review\u201d would begin. They also noted that many evaluations could drag on, citing the large caseload and ambiguity surrounding some dismissals.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Officials added that the discharge review will not include the nearly 20,000 LGBTQ+ veterans expelled from the military before the implementation of \u201cDon\u2019t Ask, Don\u2019t
