{"id":76692,"date":"2024-09-04T19:30:28","date_gmt":"2024-09-04T19:30:28","guid":{"rendered":"https:\/\/one.sightlinemg.com\/navytimes\/uncategorized\/2024\/09\/04\/judge-reduces-prison-sentence-for-army-vet-convicted-in-capitol-riot\/"},"modified":"2026-08-08T16:33:39","modified_gmt":"2026-08-08T16:33:39","slug":"judge-reduces-prison-sentence-for-army-vet-convicted-in-capitol-riot","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/navytimes\/flashpoints\/2024\/09\/04\/judge-reduces-prison-sentence-for-army-vet-convicted-in-capitol-riot\/","title":{"rendered":"Judge reduces prison sentence for Army vet convicted in Capitol riot"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">A U.S. district court judge <a href=\"https:\/\/apnews.com\/article\/thomas-robertson-police-officer-capitol-riot-supreme-court-f626494958a0672b4359afaa25d7694f\" target=\"_blank\">reduced the sentence Wednesday<\/a> for an Army veteran and former cop who was convicted on six charges for his participation in the mob that breached the U.S. Capitol on Jan. 6, 2021.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Virginia resident Thomas Robertson was <a href=\"https:\/\/www.armytimes.com\/veterans\/2022\/08\/11\/army-veteran-sentenced-to-7-years-in-prison-on-capitol-riot-charges\/?utm_source=facebook&#038;utm_medium=social&#038;utm_campaign=fb_militarytimesonline&#038;fbclid=IwY2xjawFFfzJleHRuA2FlbQIxMQABHdmcVpFQtP19yYTQ_SQWWrTF5YKghvVzcqeFO3iWNiVu6j3TLuccoAEctg_aem_1amtdARTuTkRpc15wYlDDg\" target=\"_blank\">sentenced in 2022 to serve seven years in prison<\/a> on charges of interfering with police officers during a civil disorder and entering a restricted area with a dangerous weapon. Robertson carried a large wooden stick during the riot and was photographed in the Capitol\u2019s crypt making an obscene gesture in front of a statute of John Stark, an American general during the Revolutionary War, <a href=\"https:\/\/www.armytimes.com\/news\/your-army\/2022\/04\/04\/army-vet-ex-cop-faces-jury-trial-on-capitol-riot-charges\/\" target=\"_blank\">prosecutors said during the jury trial<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">U.S. District Judge Christopher Cooper reduced Robertson\u2019s sentence Wednesday to six years in prison, The Associated Press reported. The new sentence follows Cooper\u2019s dismissal of one of Robertson\u2019s convictions: obstructing the congressional certification of President Joe Biden\u2019s 2020 electoral victory.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court ruled 6-3 in June that a charge of obstructing an official proceeding must include proof that a defendant tried to tamper with or destroy documents \u2014 a distinction that did not apply to Robertson\u2019s case, nor most of the hundreds of Jan. 6 criminal cases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Army veteran is the first Capitol riot defendant to be resentenced following the Supreme Court\u2019s ruling. In <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.226905\/gov.uscourts.dcd.226905.168.0_1.pdf\" target=\"_blank\">court filings<\/a>, prosecutors had urged the judge to preserve the original sentence.<\/p>\n\n\n<aside class=\"smg-interstitial-link smg-interstitial-link--fallback wp-block-smg-interstitial-link\"><a href=\"https:\/\/www.armytimes.com\/veterans\/2022\/08\/11\/army-veteran-sentenced-to-7-years-in-prison-on-capitol-riot-charges\/?utm_source=facebook&#038;utm_medium=social&#038;utm_campaign=fb_militarytimesonline&#038;fbclid=IwY2xjawFFfzJleHRuA2FlbQIxMQABHdmcVpFQtP19yYTQ_SQWWrTF5YKghvVzcqeFO3iWNiVu6j3TLuccoAEctg_aem_1amtdARTuTkRpc15wYlDDg\" class=\"smg-interstitial-link__fallback-link\">Army veteran sentenced to 7 years in prison on Capitol riot charges<\/a><\/aside>\n\n\n<p class=\"wp-block-paragraph\">Robertson, who declined to address the court at his first sentencing hearing, told the judge Wednesday that he looks forward to returning home and rebuilding his life after prison, AP reported.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI realize the positions that I was taking on that day were wrong,\u201d he said of Jan. 6. \u201cI\u2019m standing before you very sorry for what occurred on that day.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Robertson served four years in the U.S. Army from 1991 to 1994, and then joined the Army Reserve in 2001, his attorneys wrote in <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.226905\/gov.uscourts.dcd.226905.31.0.pdf\" target=\"_blank\">court documents<\/a>. He deployed to Iraq in 2008 and was injured by gunshot and mortar shrapnel in Afghanistan in 2011, the documents state. He underwent 10 surgeries for his injuries.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After recuperating, Robertson joined the police department in Rocky Mount, Virginia, and became a sergeant. He was off duty but still working for the police department when he joined the Capitol riot. <a href=\"https:\/\/apnews.com\/article\/capitol-siege-virginia-e6e2351fbb7b01df2c4009c47f106108\" target=\"_blank\">The town fired him <\/a>after his arrest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a Facebook post on Nov. 7, 2020, Robertson said, \u201cI\u2019ve spent most of my adult life fighting a counter insurgency. (I\u2019m) about to become part of one, and a very effective one.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before his initial sentencing in 2022, <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.226905\/gov.uscourts.dcd.226905.121.1_4.pdf\" target=\"_blank\">Robertson wrote a letter to the judge<\/a>, saying he took full responsibility for his actions on Jan. 6 and \u201cany poor decisions I made.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He blamed the vitriolic content of his social media posts on a mix of stress, alcohol abuse and \u201csubmersion in deep \u2018rabbit holes\u2019 of election conspiracy theory.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI sat around at night drinking too much and reacting to articles and sites given to me by Facebook\u201d algorithms, he wrote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><i>This story was produced in partnership with <\/i><a href=\"https:\/\/www.mvj.network\/\"><i>Military Veterans in Journalism<\/i><\/a><i>.
