{"id":78767,"date":"2024-01-24T18:04:52","date_gmt":"2024-01-24T18:04:52","guid":{"rendered":"https:\/\/one.sightlinemg.com\/navytimes\/uncategorized\/2024\/01\/24\/military-to-cover-ivf-for-unmarried-couples-single-troops-and-more\/"},"modified":"2026-08-08T15:39:33","modified_gmt":"2026-08-08T15:39:33","slug":"military-to-cover-ivf-for-unmarried-couples-single-troops-and-more","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/navytimes\/news\/your-navy\/2024\/01\/24\/military-to-cover-ivf-for-unmarried-couples-single-troops-and-more\/","title":{"rendered":"Military to cover IVF for unmarried couples, single troops and more"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Service members seeking fertility treatments are about to have a lot more options, thanks to a <a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2023\/08\/02\/now-nyc-and-air-force-veteran-sue-dod-and-va-over-ivf-policies\/\" target=\"_blank\">lawsuit filed last year<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Defense Department has decided to lift previous regulations that only covered in-vitro fertilization for legally married couples using their own sperm and eggs, according to a Dec. 26 court filing in the New York state lawsuit.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A new policy is due out next month that will allow single troops, unmarried couples and any service members using donor sperm or eggs to have their treatment covered, according to a release from Yale Law School, which filed the suit on behalf of National Organization for Women \u2013 New York City in August.<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/federaltimes\/fedlife\/benefits\/2022\/11\/07\/why-dont-federal-health-plans-cover-more-infertility-treatments\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/GettyImages-1152441056.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Why don\u2019t federal health plans cover more infertility treatments?<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Many private employers offered coverage for IVF treatment, including WalMart, Starbucks and Microsoft, but not the government.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Under the revised policy, service members in any relationship status can have IVF covered. They can also use donor sperm or eggs, where previously TRICARE would only cover IVF if the couple seeking treatments provided their own cells, excluding anyone who cannot produce viable sperm or eggs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe applaud the Department of Defense for working to expand access to fertility treatments for service members &#8230; But this is only the first step,\u201d Sonia Ossorio, NOW-NYC\u2019s executive director, said in a statement. \u201cWe will continue to challenge DoD and VA to remove all discriminatory barriers so that each and every service member and veteran who needs this reproductive care can access it.\u201d<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/news\/your-military\/2023\/02\/16\/troops-can-take-three-weeks-off-to-travel-for-abortions-ivf-treatment\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"159\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/pregnant.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Troops can take three weeks off to travel for abortions, IVF treatment<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">The services have 30 days to enact a trio of new policies that aim to guarantee service members\u2019 ability to access reproductive health care.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<p class=\"wp-block-paragraph\">Though the government\u2019s filing says that DoD expects to field a new IVF policy in February, the Pentagon was not able to confirm that timeline by Military Times\u2019 deadline on Wednesday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Department of Veterans Affairs, also named in the lawsuit, has agreed to review its policies, according to the court filing, which currently only covers heterosexual married couples for such treatment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The ongoing lawsuit also takes aim at a policy dictating that troops and veterans seeking fertility treatments can only have them covered if their infertility is considered service-linked. Examples include certain chemical exposures or injuries to reproductive organs.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And that coverage only applies to service members experiencing infertility but who can still safely carry a pregnancy, as IVF in conjunction with a gestational carrier, more commonly referred to as a surrogate, is not covered.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cService members who delay child-rearing and need IVF because of basic demands of military life, like deployments and permanent changes of station, are ineligible for care,\u201d Briana Thompson, a law student intern in the Veterans Legal Services Clinic at Yale Law School and former Air Force officer, said in the Wednesday release. \u201cThese stringent requirements are unlawful, out of step with IVF benefits provided to other federal employees, and antithetical to the centrality of the military family to
