It was updated Friday, June 13, to reflect the 9th U.S. Circuit Court of Appeals\u2019 decision.<\/i><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">SAN FRANCISCO \u2014 The 9th U.S. Circuit Court of Appeals on Thursday temporarily blocked a federal judge\u2019s order that directed President Donald Trump to return control of National Guard troops to California after he <a href=\"https:\/\/www.militarytimes.com\/news\/pentagon-congress\/2025\/06\/13\/la-unrest-cancels-more-than-600-appointments-at-citys-va-clinic\/\" target=\"_blank\" rel=\"\" title=\"https:\/\/www.militarytimes.com\/news\/pentagon-congress\/2025\/06\/13\/la-unrest-cancels-more-than-600-appointments-at-citys-va-clinic\/\">deployed them<\/a> there following protests in Los Angeles over immigration raids.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The court said it would hold a hearing on the matter on Tuesday. The ruling came only hours after a federal judge\u2019s order was to take effect at noon Friday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Earlier Thursday, U.S. District Judge Charles Breyer ruled the <a href=\"https:\/\/www.militarytimes.com\/news\/pentagon-congress\/2025\/06\/10\/trumps-military-deployments-to-la-raise-legal-political-concerns\/\" target=\"_blank\" rel=\"\" title=\"https:\/\/www.militarytimes.com\/news\/pentagon-congress\/2025\/06\/10\/trumps-military-deployments-to-la-raise-legal-political-concerns\/\">Guard deployment<\/a> was illegal and both violated the Tenth Amendment, which defines power between federal and state governments, and exceeded Trump\u2019s statutory authority. The order applied only to the National Guard troops and not Marines who were also deployed to the LA protests. Gen. Scott Sherman, commander of Task Force 51 who is overseeing the 4,700 troops deployed in Los Angeles.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Marines will join some 2,000 National Guard troops that have been on the streets of the city since last week when immigration raids set off protests.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">California Gov. Gavin Newsom, who had asked the judge for an emergency stop to troops helping carry out immigration raids, had praised the earlier ruling.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cToday was really about a test of democracy, and today we passed the test,\u201d Newsom said in a news conference before the appeals court decision.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In a post on his Truth Social platform, Trump thanked the appeals court Friday morning.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIf I didn\u2019t send the Military into Los Angeles, that city would be burning to the ground right now,\u201d he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The White House had called Breyer\u2019s order \u201cunprecedented\u201d and said it \u201cputs our brave federal officials in danger.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe district court has no authority to usurp the President\u2019s authority as Commander in Chief,\u201d White House spokesperson Anna Kelly said in a statement. \u201cThe President exercised his lawful authority to mobilize the National Guard to protect federal buildings and personnel in Gavin Newsom\u2019s lawless Los Angeles. (Etienne Laurent\/AP)<\/figcaption><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\">Marines in civil disturbance training at nearby base<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">About 700 Marines have been undergoing civil disturbance training at Naval Weapons Station Seal Beach in Orange County, California.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Typically, the authority to call up the National Guard lies with governors, but there are limited circumstances under which the president can deploy those troops. Trump federalized members of the California National Guard under an authority known as Title 10.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Title 10 allows the president to call the National Guard into federal service when the country \u201cis invaded,\u201d when \u201cthere is a rebellion or danger of a rebellion against the authority of the Government,\u201d or when the president is unable \u201cto execute the laws of the United States.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Breyer, who was appointed by former President Bill Clinton, said in his ruling that what is happening in Los Angeles does not meet the definition of a rebellion.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe protests in Los Angeles fall far short of \u2018rebellion,\u2019\u201d he wrote. \u201cIndividuals\u2019 right to protest the government is one of the fundamental rights protected by the First Amendment, and just because some stray bad actors go too far does not wipe out that right for everyone.\u201d<\/p>\n\n\n\t<aside class=\"smg-interstitial-link wp-block-smg-interstitial-link\">\n\t\t<a href=\"https:\/\/one.sightlinemg.com\/militarytimes\/news\/your-military\/2025\/06\/12\/texas-governor-deploys-5000-guardsmen-ahead-of-no-kings-protests\/\" class=\"smg-interstitial-link__inner\">\n\t\t\t\t\t\t\t<div class=\"smg-interstitial-link__media\">\n\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"200\" src=\"https:\/\/one.sightlinemg.com\/wp-content\/uploads\/2026\/08\/AP25162734966694.jpg.jpg?w=300\" class=\"smg-interstitial-link__image wp-post-image\" alt=\"\" \/>\t\t\t\t<\/div>\n\t\t\t\t\t\t<div class=\"smg-interstitial-link__content\">\n\t\t\t\t<span class=\"smg-interstitial-link__kicker\">Related<\/span>\n\t\t\t\t<h3 class=\"smg-interstitial-link__title\">Texas governor deploys 5,000 Guardsmen ahead of \u2018No Kings\u2019 protests<\/h3>\n\t\t\t\t\t\t\t\t\t<p class=\"smg-interstitial-link__excerpt\">Gov. Greg Abbott says he ordered the deployment of more than 5,000 Texas National Guard troops across Texas, along with more than 2,000 state police.<\/p>\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/a>\n\t<\/aside>\n\t\n\n\n<h2 class=\"wp-block-heading\">California sued the federal government<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Newsom sued to block the Guard\u2019s deployment against his wishes. California later filed an emergency motion asking the judge to block the Guard from assisting with immigration raids.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The governor argued that the troops were originally deployed to protect federal buildings and wanted the court to block the troops from helping protect immigration agents during the raids, saying that involving the Guard would escalate tensions and promote civil unrest.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sherman said that as of Wednesday about 500 of the Guard troops had been trained to accompany agents on <a href=\"https:\/\/www.militarytimes.com\/news\/pentagon-congress\/2025\/06\/10\/trumps-military-deployments-to-la-raise-legal-political-concerns\/\" target=\"_blank\" rel=\"\" title=\"https:\/\/www.militarytimes.com\/news\/pentagon-congress\/2025\/06\/10\/trumps-military-deployments-to-la-raise-legal-political-concerns\/\">immigration operations<\/a>. Photos of Guard soldiers providing security for the agents have already been circulated by immigration officials.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">None of the Marines have been trained to go on immigration raids, and it is not yet clear if they eventually will, Sherman said.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Trump improperly called up the Guard, judge says<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">In his broad ruling, the judge determined Trump had not properly called the Guard up in the first place.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The lawsuit argued that Title 10 also requires that the president go through governors when issuing orders to the National Guard, which the Trump administration didn\u2019t do.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Brett Shumate, an attorney for the federal government, said Trump complied with the statute by informing the general in charge of the troops of his decision and has the authority to call in the Guard even if he had not. Furthermore, the president\u2019s decisions are not subject to judicial review, Shumate argued.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cOur position is this is not subject to judicial review,\u201d Shumate told the judge.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Breyer, who at one point waved a copy of the Constitution, said he disagreed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe\u2019re talking about the president exercising his authority, and the president is, of course, limited in that authority. That\u2019s the difference between a constitutional government and King George,\u201d he said.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Protests intensified<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The protests over immigration raids in Los Angeles <a href=\"https:\/\/www.militarytimes.com\/news\/pentagon-congress\/2025\/06\/13\/la-unrest-cancels-more-than-600-appointments-at-citys-va-clinic\/\" target=\"_blank\" rel=\"\" title=\"https:\/\/www.militarytimes.com\/news\/pentagon-congress\/2025\/06\/13\/la-unrest-cancels-more-than-600-appointments-at-citys-va-clinic\/\">intensified<\/a> after Trump called up the Guard and have since <a href=\"https:\/\/www.militarytimes.com\/news\/your-military\/2025\/06\/12\/texas-governor-deploys-5000-guardsmen-ahead-of-no-kings-protests\/\" target=\"_blank\" rel=\"\" title=\"https:\/\/www.militarytimes.com\/news\/your-military\/2025\/06\/12\/texas-governor-deploys-5000-guardsmen-ahead-of-no-kings-protests\/\">spread to other cities<\/a>, including Boston, Chicago and Seattle.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Trump has described Los Angeles in dire terms that Mayor Karen Bass and Newsom say are <a href=\"https:\/\/apnews.com\/article\/los-angeles-trump-immigration-ice-raids-protests-6823da82d8d25e12d392088c7cde40c5\" target=\"_blank\" rel=\"\" title=\"https:\/\/apnews.com\/article\/los-angeles-trump-immigration-ice-raids-protests-6823da82d8d25e12d392088c7cde40c5\">nowhere close to the truth<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Most of the sprawling city has been spared as protests continue downtown, near City Hall and a federal detention center where some immigrants are being held.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A federal judge has issued a temporary restraining order directing President Trump to return control of the California National Guard to Gov.
