{"id":79673,"date":"2025-09-17T18:30:00","date_gmt":"2025-09-17T18:30:00","guid":{"rendered":"https:\/\/one.sightlinemg.com\/navytimes\/uncategorized\/2025\/09\/17\/veteran-who-burned-us-flag-in-dc-pleads-not-guilty-to-federal-charges\/"},"modified":"2026-08-08T17:08:36","modified_gmt":"2026-08-08T17:08:36","slug":"veteran-who-burned-us-flag-in-dc-pleads-not-guilty-to-federal-charges","status":"publish","type":"post","link":"https:\/\/one.sightlinemg.com\/navytimes\/veterans\/2025\/09\/17\/veteran-who-burned-us-flag-in-dc-pleads-not-guilty-to-federal-charges\/","title":{"rendered":"Veteran who burned US flag in DC pleads not guilty to federal charges"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">An Army veteran who set fire to an American flag near the White House to protest President Donald Trump\u2019s recent <a href=\"https:\/\/apnews.com\/article\/trump-executive-order-flag-burning-4628d588350db4f6baf10ae1d91f49c1\" target=\"_blank\" rel=\"\" title=\"https:\/\/apnews.com\/article\/trump-executive-order-flag-burning-4628d588350db4f6baf10ae1d91f49c1\">executive order<\/a> on flag burning pleaded not guilty Wednesday to <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.284292\/gov.uscourts.dcd.284292.1.0.pdf\" target=\"_blank\" rel=\"\" title=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.284292\/gov.uscourts.dcd.284292.1.0.pdf\">federal criminal charges<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Jan Carey is charged with two misdemeanors that are not focused on the act of burning a flag. Making his initial court appearance, Carey was arraigned on charges of igniting a fire in an undesignated area and lighting a fire causing damage to property or park resources.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Chief Judge James Boasberg set an Oct. 17 deadline for Carey\u2019s lawyers to file a motion to dismiss the case on constitutional grounds. Carey is due back in court on Dec. 1 for a status hearing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Carey, 54, of Arden, North Carolina, was arrested on Aug. 25 after he set fire to a flag in <a href=\"https:\/\/www.nps.gov\/places\/000\/lafayette-park.htm\" target=\"_blank\" rel=\"\" title=\"https:\/\/www.nps.gov\/places\/000\/lafayette-park.htm\">Lafayette Park<\/a>, which the National Park Service oversees. Earlier that day, Trump signed an <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/08\/prosecuting-burning-of-the-american-flag\/\" target=\"_blank\" rel=\"\" title=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/08\/prosecuting-burning-of-the-american-flag\/\">executive order<\/a> requiring the Justice Department to investigate and prosecute people for burning the American flag.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court has ruled that flag burning is a legitimate political expression protected by the Constitution. Trump\u2019s order asserts that burning a flag can be prosecuted if it \u201cis likely to incite imminent lawless action\u201d or amounts to \u201cfighting words.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cYou burn a flag, you get one year in jail. You don\u2019t get 10 years, you don\u2019t get one month,\u201d Trump said. \u201cYou get one year in jail, and it goes on your record, and you will see flag burning stopping immediately.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Carey said he served in the Army from 1989 to 2012 and was deployed to Iraq and Afghanistan.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI served this country for over 20 years, having taken an oath to upheld our Constitution. I did not take an oath to serve a dictator, a tyrant or a wannabe king,\u201d he told reporters after the hearing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">U.S. Attorney Jeanine Pirro\u2019s office filed the charges against Carey. Trump appointed Pirro, a former Fox News host and former judge.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAlthough we respect the First Amendment, there is a law that prohibits the burning of anything, including a flag, on federal property,\u201d office spokesman Tim Lauer said in a statement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mara Verheyden-Hilliard, one of Carey\u2019s lawyers, said the charges against him represent an effort by the Trump administration to stifle free speech and dissent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis is a desecration of the First Amendment by the administration, and it is crucial that people stand up and speak out, exercise their rights,\u201d said Verheyden-Hilliard, co-founder of the Partnership for Civil Justice
