Robert P. Burke \u2014 once the second-highest uniformed officer in the Navy \u2014 was commanding its forces in Europe and Africa when he engaged in a bribery plot with two business executives, according to federal prosecutors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A jury convicted Burke of four counts, including conspiracy and accepting a bribe, after a trial in May. A separate trial for Burke\u2019s two co-defendants \u2014 Next Jump co-CEOs Yongchul \u201cCharlie\u201d Kim and Meghan Messenger \u2014 ended with a hung jury and a mistrial last Thursday.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Burke, 63, declined to address the court before U.S. District Judge Trevor McFadden in Washington, D.C., sentenced him.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis was blatantly unlawful, as you well knew,\u201d the judge told him. \u201cBut you did it anyway.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The judge told Burke that he betrayed the public\u2019s trust and his oath of office.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis is a sad day and a sad chapter in the U.S. Navy,\u201d McFadden said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prosecutors sought a 10-year prison sentence for Burke, saying he abused his powerful position to enrich himself at the Navy\u2019s expense.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cBurke\u2019s conduct was as blatant and egregious as it was damaging to the public\u2019s trust in its leaders and corrosive to the integrity of the procurement system,\u201d <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.269178\/gov.uscourts.dcd.269178.321.0.pdf\" target=\"_blank\" rel=\"\" title=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.269178\/gov.uscourts.dcd.269178.321.0.pdf\">prosecutors wrote<\/a>. \u201cHis offense demands accountability. His crime calls out for punishment.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Burke\u2019s attorneys say they will appeal his convictions. They cited his \u201clifetime of extraordinary public service\u201d in asking the judge to spare Burke from a prison sentence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis is not a case of a career criminal,\u201d <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.269178\/gov.uscourts.dcd.269178.322.0.pdf\" target=\"_blank\" rel=\"\" title=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.dcd.269178\/gov.uscourts.dcd.269178.322.0.pdf\">they wrote<\/a>. \u201cIt is the case of a single, tragic, and aberrant chapter at the very end of a life defined by honor, courage, and commitment.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kim and Messenger agreed to pay Burke a $500,000 salary with stock options projected to be worth millions of dollars, according to prosecutors. In exchange, they said, Burke ordered his staff to give a contract to Next Jump and promoted the company\u2019s product to other senior Navy commanders.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Burke\u2019s attorneys said a military commander with his experience could have landed a better-paying job in the private sector.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cHe was not motivated by greed, but by a belief in the mission and product of the company,\u201d they wrote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In 2018, Next Jump had a multimillion-dollar Navy contract to provide workforce training to an office under Burke\u2019s command. But the Navy terminated the \u201cpoorly received\u201d pilot program after approximately one year, prosecutors said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In 2021, Burke privately met with Kim and Messenger to discuss another contract. Kim and Messenger proposed a contract \u201cto provide basically the same programming that had failed two years earlier,\u201d according to prosecutors. Several months later, Burke ordered subordinates to ensure Next Jump had a contract to train Navy personnel in Italy and Spain, prosecutors said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe truth is, Burke knew this training was a waste of time and money, and not suitable for his command, let alone the entire Navy,\u201d prosecutors wrote.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Burke later retired from the Navy and joined Next Jump in October 2022.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Reed Brodsky, one of Messenger\u2019s attorneys, said there was no link between the job offer and the contract. Brodsky argued at trial that Burke repeatedly lied to Messenger and Kim about the contracting process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThey relied on the admiral.
