ATLANTA – A federal judge has dismissed a lawsuit accusing filmmaker Tyler Perry of unfairly working with government officials to transform a former military base in metro Atlanta into a studio for Perry’s company.
U.S. District Judge Richard W. Story ruled Tuesday that the court lacks jurisdiction.
The Atlanta Journal-Constitution reports that Story didn’t rule on merits of the case, but found the court doesn’t have jurisdiction yet since the Army hasn’t yet conveyed the former Fort McPherson property to an authority working to redevelop it.
The plaintiff, Atlanta-based Ubiquitous Entertainment, says its CEO met with the authority’s chairman in 2011 to share its vision for a studio at the site.
Ubiquitous maintains Perry tried to persuade the authority to negotiate a similar deal with his company instead.
Perry’s representatives haven’t commented on the dispute.
